My wife parked in car park in east kilbride to go to the cinema with our daughter.on her return she paid at the machine then left.
5 weeks later I receive a parking notice from Britannia as I was the registered keeper. My wife and daughter both confirmed she had put money in the machine, the only thing she could think of is she maybe entered a wrong digit for number plate. This letter was quickly forgot about. then we started receiving letters about every 6 weeks for about 11 months.
This all occurred on January 3rd 2017. 
I have recently received a letter from bw legal asking for £165
I was even called by someone regarding this, they asked me to confirm my address then asked if I could confirm vehicle registration details which I never. I asked what it was regarding they said they couldn't tell me until I confirmed some vehicle details. I just told him 
I wasn't interested and hung up.
I was really surprised after all this time they are still pursuing this.
Should I be concerned about this ?

    Of course they are , they are all skint due to covid19 😁😁😁

    They are all trawling through the old invoices after blowing off the cobwebs and dust , looking for numpties and trying to trick them into admissions and payment , no win , no fee

    Nothing to worry about but Scotland IS about to get 'keeper liability' next year unless their Government see sense and decide not to take that leap at all, as your people and your courts really do not need the unjustified and greedy PPC litigation and hassle that has plagued England and Wales in the years since the ill-conceived Schedule 4 of the POFA became law.

    That's the law your Government thinks it will be clever to copy...

    Anyway, please stick around here this Summer as this is important whether you are in England, Wales or Scotland:

    Do come back regularly in August (please) to take part in the Government Consultation about the level of private parking charges and the proposed Appeals 'Charter' that should result in cancelled PCNs but at the moment, fails to do that and just incentivises PPCs to issue PCNs anyway, briefly offer twenty quid then rack it back up and pile on the pressure. 

    The Appeals Charter is absolutely not acceptable in its current format which is effectively:

     'let us have £20 anyway even though the ticket was spurious, and if you don't pay up within xx days then we'll hike it back to full price, and add imaginary 'recovery costs' that we've never actually incurred, let alone paid... then we'll drag you to court months/years later, or get you a CCJ by default for a PCN the Government might think we've kind of cancelled.'

    I believe the MHCLG will be asking about that, as well as the level of parking charges.  I read it in an article somewhere over the weekend so I hope the Appeals Charter will be one of the questions for the public.

    No such thing as a "£165" paking ticket ?
    They are phishing for the driver because that is all that works in Scotland

    BWLegal are well known for their bully phone calls ....it's like all the scam calls we receive, you either talk to them .. or put the phone next to the radio speaker and let them rock on.

    BUT, they are doing this because they know Scotland is a problem.

    You may also get a copy and paste letter saying they are sure they will win ???

    Seen that loads of time .... and they lose

    Almost certainly this has added unlawful amounts, read this and complaim to your MP.

    Excel v Wilkinson


    At the Bradford County Court, District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) decided to hear a 'test case' a few months ago, where £60 had been added to a parking charge despite Judges up and down the country repeatedly disallowing that sum and warning parking firms not to waste court time with such spurious claims.   That case was Excel v Wilkinson: G4QZ465V, heard in July 2020 and leave to appeal was refused and that route was not pursued.  The Judge concluded that such claims are proceedings with 'an improper collateral purpose'.   This Judge - and others who have since copied her words and struck dozens of cases out in late 2020 and into 2021 - went into significant detail and concluded that parking operators (such as this Claimant) are seeking to circumvent CPR 27.14 as well as breaching the Consumer Rights Act 2015.   DJ Hickinbottom has recently struck more cases out in that court area, stating: ''I find that striking out this claim is the only appropriate manner in which the disapproval of the court can be shown''.

    Not allowed , not even with a court order , especially not without and especially not in Scotland , you have been watching too much English TV !!

    Enforcement In. Scotland is completely different to us down here !!  Look at your simple procedures system for small claims and the sheriff system of courts , then look at enforcement under Scottish law !!  Not the same as England and Wales is it ?? Definitely not !
