    Well, you could sell it, as long as you bear in mind the (probably quite small) risk of being chased up for the value at a later date. It never legally becomes yours though.

    You're thinking of the law regarding unsolicited goods. As your 'faulty' phone was not unsolicited that doesn't apply.

    Yes, it would be a very small risk indeed as they're not even aware of it. But I would feel more comfortable if I was on solid ground. I'm going to drop them an email tomorrow (so that  have it in writing) asking them what they want me to do with this phone that's been sitting here for 8 months. See how they respond, if they respond at all

    Err..you forgot to add "if you sell it" onto the end of that. Which is why I'm not going to until I've contacted vodafone, to get on "solid ground". And which is also why I asked the original question. But thank you for that insight

    I ordered one item from a charity, I first received an incorrect item, correct item, a duplicate item, another incorrect item, all arriving separately. 

    This was April/May 2020.

    I said they could have the incorrect goods back if they sent a postage label which the web shop manager agreed.

    No label ever came so I emailed again recently. Surprise surprise, told by the same website manager their fulfillment company was so bad they've taken back control and do it themselves now, and they had asked fulfillment company to handle my return. 

    I repeated over several emails they can have the three incorrect items back (one is now out of date) if they send me a postage label. I gave them a deadline of 30 days after which I've informed them I will be disposing of the items.

    He agreed to my terms in writing but has yet to send a label...

    As far as I'm concerned I've bent over backwards to return their stuff, gave them loads of time and it's up to them what I do next.

    I actually think this was unreasonable and surprised they allowed it. Like any other item you get it replaced you have to give the old one back.

    There's no such thing as transferring data over from one phone on the another these days. Everything required should be backed up so you can reinstall. What would you do if you lost it? 

    Any new phone/tablet transfers most things you require when you connect it to your google account or even apple for their devices.

    No they're not. Theft requires criminal intent, which isn't present here.
