What the case did show was how disorganised, especially with paperwork (lack of) everybody seemed to be and I include judge, solicitor's agent and even Mr Ferguson - defendant.1 -
I have to say that imo the defendant put his case extremely badly.

£1,500 was the amount he counterclaimed, and he was awarded the full amount. It was not open to the Judge to assess the damages at a higher figure.
If he had claimed more, he may well have been awarded more, but he didn't, so he wasn't.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. It just sticks in the craw that a PPC can make all those serious errors, wreck people's lives, then wriggle and squirm to protest innocence and argue not to pay a copper in compensation. Yet should a motorist be 2 minutes late back to his car .......
No doubt this case will haunt VCS in time yet to come!

He may have claimed that amount, but it is still peanuts, it would not even buy a second hand saddle for my bike.

Jesus wept. That was never going to fly. VCS should've just made formal offers before the hearing then admitted the claim. They'd at least have had a chance of mitigating their costs.
The advocate comes perilously close to giving evidence - lots of surmising going on: He's incorrectly described on p1 as a solicitor when he isn't. Mr Ferguson gives clearer answers. Pleased he had it handed to him.
It seems the Ferguson clan are successful litigants on matters of harassment! VCS v Ferguson & Ferguson v British Gas being the authorities.
