VCS Hit For £1,500 Counterclaim - 5 years worth of Harassment

The D was sent a PCN for an alleged parking breach, naming a location which he believed was in Portsmouth where he lives. It turned out that the actual location was in Sheffield, a city he had never been to, and there had been an ANPR misread, substituting a U for a V. The photos of the car also showed that it was a different colour from his.
Despite all this, VCS and various debt collectors continued to pursue and harass the D for over 5 years, culminating in a court claim, to which a counterclaim for £1,500 was filed, relying upon Ferguson v British Gas as authority.
VCS then discontinued their claim, and offered to settle the counterclaim for £1,000 if the D signed a non-disclosure agreement. He declined, confident in getting the full sum counterclaimed, and wishing to expose VCS’s arrogant and bullying conduct to a wider audience.
The Judge completely agreed, and at the hearing, roasted their advocate over hot coals. Oh to be a fly on the wall in SRS’s office when their rep phoned through the result.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. Last year Smart Parking sent my brother a PCN with pictures for a charge in Perth
Misread on the VRM plus it was a VW not a Toyota !! Wrong colour too
They did cancel it at the initial appeal where he told them to go to Specsavers ( plus he has never been to Perth , not in any vehicle at all )6 -

. The evidence of Mr , which again I accept, as it is the only evidence before me, is that every time he has received communications from the Claimant or their agents, he has responded. He also did a subject access request so he could actually try to get to the bottom of this. 8. The reality of the matter is that Mr has acted reasonably throughout by seeking to challenge this and has clarified that he knows nothing about it each time has received a communication. He was right to do so because his car was never involved.
Judges do like it if you try to sort things pre court. IAS appeals ARE worth it even if the odds of winning are low.

Yes I am coming around to that view but it’s so hard to get it into newbies’ heads that they don’t have to pay when 96% of them lose.
