Lawyer has made error in our offer

    You should get a list of fixtures and fittings to check  such as washing machine, tumble drier, fridge etc.

    Although your offer has been accepted it is not binding   until missives are concluded. Until then the seller could back out , or you could back out.


    None of us want to back out. The problem is my lawyer took 2 months to realise the discrepancy and the sellers have already sold a substantial amount of the items.

    My parents recently sold a house and in the offer it included wall mounted TV’s and Mirrors. Our lawyer never found it weird at the time and has entirely admitted their mistake.

    Don't you already have a table and chairs at your old home? Or bed, since you're talking about sleeping on the floor?

    Go to IKEA, and you can get a dining table and four chairs for £99. Another £80 for a sofa. £40 for a double bed frame and £75 for a double mattress. Garden table and two chairs, £35. Sure, they may not be what you actually want long-term, but they'll do as a stop-gap.
    Job jobbed, less than £350 spent.
    We payed 11k over the asking price for the extra why would I want to waste time purchasing and building ikea furniture?

    simple question... my lawyer messed up my offer and has only informed 6 days before settlement even though she should have noticed this 2 months prior when the offer was accepted, do I have any rights?

    if you don’t know why spend an hour writing that response up? 

    FYI I don’t know the last time you bought a house or the type of house that was but mounted and integrated TV’s are quite common to include in an offer these days. If it blow up I would do the same thing as I would do if the lighting circuit blew... contact my lawyer.

    I never gave all the numbers.

    asking price - 205k

    first offer - 215k including a list of furniture 

    house had some more viewings that night. So next day...

    Second offer - 216k including list of furniture.

    Accepted.

    2 months later no furniture. 

    I’m not asking you to resolve this. I was asking where to get help.

    what was the point in that message on a forum that’s to help people?

    To achieve what, did you manage to get a guarantee with the list of kit that didn't get transferred?
    Your life is too short to be unhappy 5 days a week in exchange for 2 days of freedom!

    So the vendors knew you wanted the list of furniture, and accepted on that basis.... then didn't query why the list didn't appear in later correspondence, and went on to sell it all?

    But they still expect you to pay what was originally offered?

    Isn't it the vendors who need some harsh words directed at them? Either to replace the items sold, or accept a revised offer.

    No our lawyer forgot to include the list in our second offer and has admitted this.

    things seem to be moving in the right direction now 👍

    When we bought our first house the estate agents details said all furniture was being left. It turned out this was because the family were emigrating. It was good for us as we were poor ftbs.

    When we got the very, very, final details including list of stuff being left these things suddenly weren't on there. Oh, they had seen a house they liked and decided to stay in the UK. In fact about 20 doors away!! We'd lost the furniture and suddenly become a chain!! Thanks mate.

    We had a choice but that was to exchange or not.

    We actually moaned a bit,  while they were sorting their mortgage, and they ended up agreeing to leave a few things. It was enough to get us started.

    What's your offer relative to the asking got to do with anything?

    It's very simple.

    House sales normally include no furniture, fixtures or fittings.

    If you want them to, then the TA6 PIF* is the way the vendor says what they plan to include. Everything from there to exchange is negotiation.

    (* - Englandcestershire. IIRC you're in Sporranland? The form name may vary)

    ...who would simply tell you to investigate the warranty documentation and proof-of-sale from when it was new...

    Throwing a second-hand telly in with a house sale carries no warranty, unless you have the paperwork to show it was still under the manufacturer warranty.
