I may have dropped a clanger !
WS got sent just in time. Had receipt acknowledgment from DCBL and (eventually) the local Court. Great, now all I have to plan for is the hearing.
Just realised that I sent it signed ok, but not dated on the signature. Is this a critical issue, and what can I do about it, given that the hearing is in 10 days from Monday? The pen is mightier than the sword ..... and I have many pens.0 -
Send a follow up email with the WS dated.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Having said that @Trainerman did used to post quite regularly and it would be good to know the outcome of the hearing.

Thank you for the enquiries @tygrysek and @Boat_to_Bolivia. Caught me on a rare occasion when I could reply.
First, an explanation. I have only recently come out of a hospital stay caused by something nasty called a pneumothorax, only to be hit almost immediately with something else.
I will be away from the computer for another seven days but then hope to be able to come back and contribute regularly.
As regards the PCNs The Judge was very interested in the fact that our claims of pre existing rights had not been responded to at all by the DCB witness statement and put their rep under a bit of pressure about that. He then decided that he would reserve all four cases to himself (four people, seven PCNs) to a later date and that in the meantime we kept him advised about the main easement case going to Tribunal.
It is almost certain his end date will be before Tribunal so he will hear them Aug/Sept. Very interesting, fair and thorough Judge and if I heard an aside correctly, he has already told the rent-a-rep that he is only looking at the PCNs and goodbye already to the fake add ons.

@Trainerman so sorry to hear about your health issues. Wishing you all the best.
That's a positive result. Please keep us posted!3 -
Thank you for the update @Trainerman. I hope you are fully recovered now and we look forward to seeing you back on these boards.
All the best.1 -
After all this time, the long running saga might be coming to an end, that end being that we have easements registered with the Land Registry.
However, there is a Settlement Agreement to be signed first. There are two clauses in it that look a bit iffy to my way of thinking. Local Solicitors do not seem to be interested in a small job, and in any case seeing the work on here helps me trust the people here
So, if any of the 'legals' on here could have a look at a three sides of A4 contract and give an opinion, that would be very helpful. I do not expect a freebie, I expect to pay but could do with skilled people having a look.
PM me if you like

Well, the Court has slipped me a bit of a crippler here, and I would appreciate advice from those who are clear on Court procedure . This is for the PCNs issued a long time ago, and originally the Judge delayed hearing these cases until the easement situation was resolved.
We have now received orders to attend a case management hearing in only about three weeks ! We have not had any opportunity to state availability and I now have a problem.
I have a pre-booked and paid for holiday that includes the date stipulated, and almost immediately after that I have to have a minor operation in hospital. To just dump this on us with such short notice seems a little unreasonable.
The paperwork states that I would have to apply for an adjournment at a cost of £275 OR get agreement from the other parties. There are a total of four defendants and getting agreement there is easy. However I assume that I need agreement from One Parking Solution/DCB legal and I am not holding my breath on that.
My questions are : - 1) Am I right in understanding that adjournment is the only route or are there alternatives?
2) If I have to go this route, what is the actual mechanism for getting a firm/written agreement
from the 'other side' that would satisfy the Court ?
As always, thank you for the help
