Imaging my surprise.How long before Bristol Airport does something similar like Bournemouth by ripping up any pavements from the A38 towards the terminal building and placing obstructions on the verges so any people getting dropped off/picked up from outside the airport has a hazardous walk along the main road with signs saying "no pedestrian access" ? The ICO are dragging their heels. I helped my relative make a complaint to them that the DVLA released his personal data without checking that they had the right to do so, and failed to do any checks other than that the PPC was an ATA member.
The ICO replied stating that they will not make a decision on my relative's individual case because they are investigating the broader issues of releasing data. We complained that this was not fair to an individual.
We have now received another email saying much the same thing, and a change of case worker.
"In relation to your data protection and personal information rights complaint, we would like to advise that the ICO is still in the process of considering the broader issues raised in relation to the sharing of keeper data by the DVLA and how that processing complies with the UK General Data Protection Regulation (GDPR).At this present time the Information Commissioner has not concluded their view on this topic and we would therefore like to explain that we will be unable to provide an outcome until our view is finalised."
VCS issued a charge for stopping in a no stopping zone. We pointed out to the ICO that the PPCs own photos showed that the car was outside the no stopping zone and was outside the area that VCS are contracted to operate. We included this proof to show that the DVLA had no reason to release personal data. We also pointed out that my relative has mental health issues and has special needs, yet the DVLA failed to check whether or not the data subject was a vulnerable adult before releasing his data.
We are going to complain again to this new caseworker that this is unfair. The broader issue is irrelevant in this case since the evidence clearly shows a data breach occurred. We are also going to bring this up with his MP, who was helpful last time we complained, and stated that they fully supported Sir Greg's bill.I married my cousin. I imagine IAS binned it off as they don't want or can afford for it to go further. I would certainly make the Press aware of this and your MP.3 -
I love the fact the ICO are investigating the broader issues of 'no-questions-asked' automatic dishing out of keeper data to all and sundry (including convicted criminals) as long as they wear an APA AOS hat.
But given they will likely only ask the APAs and their close mates at the DVLA for evidence because the ICO won't know who else to ask, I'm not holding my breath.
However, what with this and the Keller Lenkner group claim and the imminent statutory regulation of the industry, the stars do seem to be aligning to bring the worst excesses to an end. We hope.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
