Defence for claim form

Options
Hi Guys,

Firstly, just want to say I have benefited from reading the newbie post and have some understanding to the procedure. However, I do need further guidance if possible.

Last year I had travelled out of my usual place of living and rented an airbnb from an aquntance.  They had informed me that I could park in a certain spot that had a sign stating do not park. He stated that as he was overseeing the premises it was ok to park in said private property as he was managing some properties there. I took that for what it was worth and received a notice on my car the next day, not a fine but a notice. I had informed said aquintaince and they stated that has not happened before but not to worry about it. I parked there the next day again and received another notice and decided regardless of what was said it was not worth the risk to continue. I emailed the parking agency on the notice stating my concern and they did not respond to me. Some time later I had received 2 fines from the 2 notices.

I appealed and they rejected the appeal now a claim form has come through. I have sent the acknowledgment and now working through the defence. However, I am wondering which argument has more of a leg to stand on. The fact that I was misinformed, and if this is the case should I try to get a letter from the aquitance or that the parking company did not pick up the phone or respond to me via email when I tried to contact them.

In regards to the defence i have seen the format via the newbies section and it is still a little confusing for me could anyone help break it down?

Much appreciated :)

  • Just to add for each fine they are trying to claim around 250 pounds!

These are not 'fines'. Who are 'they'?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

What is the Issue Date on your County Court Claim Form?

Upon what date did you file an Acknowledgment of Service?
Your MCOL Claim History will have the definitive answer to that.

What is the exact full name of the company listed as the Defendant on your County Court Claim Form?

I have done that last week I am just spending this weekend researching/ writing my defence. I have gone through the newbie section and looked at the template I am still slightly confused in regards to how I need to prepare my specific argument as it involves someone else telling me I can park in a private spot.
