  • Hi all,

    This is still going on.....

I made a formal complate the solictor, following there own complants process and this was totaly ignored with no knowledgement or even reply.

Made a complant to the solictors ombusman and they took on the complaint contacted teh solictor and i belive have had a reply. they have advised it migth be 18 months before they can look at it and investigate.

I have emailed the solictors again asking for an update and it would appear that again we are no further forward.

Any advice or pointers regarding what I/We can do

The solicitor works for the estate of the deceased not you. Nor are they going to divulge any sensitive information if court action is underway.

You are saying that after three years with no action and very little communication fromteh solictor, with mounting intrest on the social services care bill,  the estate not being closed and distrubited and the estate losing out on a very low rent being paid by the family member that moved into my late grandmothers house its acceptable for them not to tell anyone what is going in.  If so i fond that very hard to belive....

I tell you what i will take my car to the garage to get some new tyres, and not query how long the tyres will take to be fitted and expect no information from the tyre company - because they migth have some sensitive information about where the tyres are coming from??

Sounds like the real problem is getting the family member out of the property so it can be sold - that could take a very long time yet given the court backlogs. The estate isn't going to be able to get finalised until that's done.

Not much the solicitor can do in the meantime.

The main beneficiaries can ask for more information - so your Mum and the other person fur to inherit. Other family members can't. So You  personally can't as from what you have said, you are not one of the residuary beneficiaries or even a  beneficiary, but it sounds as though your mum is and can.

While your mum and the other beneficiaries are not the client it would be fairly usual to keep them informed .

The residuary beneficiary can use a firms complaints process and apply to the Legal Ombudsman if the complaint is not resolved
All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)

    Hello

Well they could answer the emails asking for info - even if there is no different information it would nice to be told what is going on.  The last communication we had was from June 2021.

    Hello

I am named as a beneficiary and i will in the end inherit some money.

We have complained using the firms complaints process allready and that complaint has been ignored. After waiting two months for a reply from the solicotor with no responce. We have also complained to the legal obbudsman directly, i belive they have recived a responce from the solicotor regarding our complaint to the Legal Ombusman but we are yet to see the responce from the solicotor.  However the Legal Ombusman advise that they will not be looking in the complaint for about 18 months.

I belive that during lockdown evictions could have been processed if there was a large amount of money owing? as the current rent that is being paid is only £100 pounds and a rought rental of that type of house in that area is in excess £1400 pounds per month could the eviciton processs have been started?
