I have written to Hyde explaining the situation and asking if they can cancel the AM Parking ticket. However, and I was unaware of this, AM are no longer managing this site. So AM are chasing a ticket given 3 years ago

AM are simply desperate for money.
Gladstones will take on any old rubbish and are incompetent.

Find out why AM left, normally it would be the sack, . The reason may well help if it goes to court.

Also, I approched my landlord about it (Hyde) but they just came back with "Hyde is not responsible for parking fines and this will need to be addressed with the Enforcement Company." Does anyone have insight into landlords obligations in these cases?

If Hyde employed the PPC then they are resposible for their agents.
If they sacked them, there is litte Hyde can do.  They should be on your side.   Find out WHY ?

Gladstones will take on cases they know nothing about. Gladstones are used to being spanked in court .....  Assume they have provided you with pictures of the signs at the time ..... , if not ask for yjem

And don’t ask for a paper copy of the forms that the NEWBIES thread tells everyone not to use.

    complain to your MP.
I have found the Email address to write to my MP, Helen Grant. You really think she would care about, or be able to do anything about a parking ticket? What should I say in my Email?

if you if you don’t know why MPs will be interested you haven’t yet read any of my posts about the upcoming Government Consultation resulting from the new law that MPs voted through to regulate the private parking industry.

Ref the Parking (Code of Practice) Act 2019 which is being finalised within months to change this ‘cowboy’ (MPs words) industry, MPs are required to take an interest and help constituents.

Thanks, I went and looked this up. So basically a new law is coming soon, so now PPCs are trying to milk as much money as they can, even from old tickets, before new laws come into force?

What should I say in my Email?

Tell him/her what  happened and why you think that no genuine BOC occurred.
You never know how far you can go until you go too far.

    Sums it up!

But there is a final Public Consultation soon, so don't miss that.  We will be talking about it when it is 'live'.

So I've send a SAR to AM Parking using a template I found on here and I've also send an e-mail to Gladstones as told to do in the newbies thread, saying "I am seeking debt advice but I deny any debt and the case must be put 'on hold' for not less than 30 days under the PAP for debt claims 2017."

I've e-mailed Hyde asking about why AM stopped managing the parking here, awaiting reply. They have said they cannot do anything else to help me with the ticket.

I have read my lease and found the part about peaceful enjoyment. It reads:
"...may peaceably enjoy the premisis during the term without any lawful interruption by the landlord or any person rightfully claiming under or in trust for it." Would this be the primacy of contract over the supposed contract with AM?

The are a few mentions of parking but the only relevant parts as far as I can tell are:
Vehicles belonging to me must not "remain on any part of the estate common parts in such manner as to obstruct the ready approach to any part of the building or the estate." This might be relevant because I was parked on the roadway (because another car was in my space!) however it was not obstructing anything, as there was plenty of space, at least 3 cars width, still there to pass.

    Then there is this part:
"The right at all times to use the common estate parts (but save and excepting any visitors parking spaces or designated parking spaces intended for the sole use by any other party) for all purposes incidental to the occupation and enjoyment of the premises (but not further or otherwise)" As I read elsewhere on this forum, "all purposes" includes parking so again this has primacy over any contract with AM?

Yes that gives you primacy of contract and there is nothing about any charges or permits or the requirement to refer to any signage on site that can in any way vary or interfere with these rights.

Do you mean you are a leaseholder or tenant?
