Faulty trainers? - Refund help needed

Hi,
I ordered a pair of Nike Air Max 270 trainers from ASOS on 11th May and they arrived on 13th May. They cost £130 (by far the most I have ever spent in on a pair of trainers) and they are the most comfortable trainers I have ever owned. I have worn them approx 20-30 times for short walks only.

Today however, I noticed that there is a hole in the toe of the mesh upper material on one side. The returns window for ASOS closed on 11th June if not faulty. Nike website says you can return within 60 days if unhappy, but there is no mention on if you can return if you have bought through a third party site.
My question is would these be considered to be faulty? I would definitely expect them to last longer than 7 weeks, especially for the price. Should I contact ASOS or Nike directly? Can anyone advise of my rights please?

They may not be faulty. Long or jagged toenail, perhaps? I've gone through shoes with a mesh upper before for that reason. With some shoes built to minimise weight and maximise breathability, they can be flimsy.Hi,

First of all... what do you think has happened? Was it there all the time and you haven't noticed it? Have you snagged it on something and torn it? If its the latter its very difficult to consider they should be able to withstand such a thing unscathed or not.
Your statutory rights are with the retailer not the manufacturer. As you've had them between 30 days and 6 months you are in the period where its assumed they were faulty unless the retailer can show otherwise... outside of this window it'd be your job to prove they were faulty.
In reality it seems like you have snagged them and its debatable if minor cosmetic damage is unreasonable in something that is clearly built to be light weight and flexible etc rather than rugged and robust.0 -

You could catch it on anything - twig, stick, brick, anything... and that's before you get to thinking it could be big toes
