    That would probably depend on a number of factors, such as is the individual registered as S/E with HMRC and whether or not the eBay selling is treated as a business and the appropriate earnings declared to HMRC. 

    As an example, DH operates a business using eBay as a selling platform, is registered as a business on eBay, buys goods/materials to make items to sell onto others, is registered as S/E with HMRC and completes a self-assessment every year.

    One would assume the gainful self-employed test would be applied, for Tax Credits purposes?

    A cursory search throws up lots of results for UC and the relevant bits for the gainful employment test have been redacted from the version of the Tax Credits Manual that I could find.  This is absolutely not my area of experience. 

    However, it may be pertinent to know that sole traders have to register with HMRC if they are trading - selling stock bought with the intention of selling for profit - and earn over £1000 (gross, not profit) from it.  This applies to any trading including eBay, and traders like this are expected to register for a business account on eBay.

    my wife works 8 hours a week, I will hopefully be working 12 hours earning roughly 7300pa plus 4 hours a week selling on ebay
  • Is the 4 hours just a sell what’s around the house I don’t need anymore thing? Or a buy and sell situation?

    No I will hopefully scouring the internet and shops like poundland etc.. looking for stuff to sell
