We purchased a PC via Amazon from a 3rd party TECBUYER the PC a Fierce PC it stopped working at the weekend. I contacted TECBUYER via WhatsApp on Saturday and they said to contact the manufacturer Fierce PC which I did.
They emailed back to say that TECBUYer essentially was selling them fraudulently on Amazon and they had sent Cease and desist to Amazon and Tecbuyer and the listings were removed. Meaning that the warranty was invalid and to contact Amazon.
Amazon have been terrible in general. Contacted them on Monday they said we needed to contact Tecbuyer again and give them 48hours to answer. Ive been given the run around by Amazon and Im sick of the chat disconnecting, Im constantly having to re explain and to be told different things.
Does anyone have any idea what my rights are and how I get hold of anyone in their legal department. I bought in good faith and now TECBUYER won't reply

Your consumer rights are with the party you purchased the PC from, which is TecBuyer.poost said:We purchased a PC via Amazon from a 3rd party TECBUYER the PC a Fierce PC it stopped working at the weekend. You should follow the Amazon A to Z complaints procedures because provided you follow the correct procedure (rather than just shout at the call centre staff) then Amazon are usually fair in resolving customer complaints from third party sellers,.
TecBuyer are still selling products on Amazon's website, they have not been removed.

Does the listings being removed not apply to selling Fierce PC products .0

Did they say what was "fraudulent" about them? Doesn't sound like they are counterfeit products and so probably what they really mean is that the vender is not an authorised retailer. This obviously doesn't make it "fraudulent" and normally the one in the wrong isnt the vendor you bought from but the wholesaler giving them the stock.poost said:They emailed back to say that TECBUYer essentially was selling them fraudulently on Amazon and they had sent Cease and desist to Amazon and Tecbuyer and the listings were removed. Have you actually read the warranty to see if it states that it must be from an authorised seller? Or they reserve full discretion?
Ultimately your quickest route is likely to be via the Amazon A-Z process.0 -
OP warranty is not your Consumer Rights against the vendor .

TECBUYER have not been removed but they have had to remove selling any of the FIERCE PC products as they have fraudulently being selling them. So therefore selling fraudulent warranties that don't exist.0 -

Yes indeed but they have sold the PC which they built with a warranty that is invalid because of the fact they are not a reseller and have missed the product as a genuine Fierce PC reseller.

Seller does not have to provide a warranty .Warranty is not your Consumer Rights .0

A company not wanting their product in a certain marketplace doesn’t mean they can necessarily prevent it.poost said:

Amazon will simply act on any infringement claim to protect themselves.
A brand owner using infringement claims simply to control supply is anti-competitive.All that said the issue between the retailer and manufacturer most probably doesn’t pertain to you as a consumer. Was the unit sold with a warranty and what does the warranty say about it being valid or not depending upon where purchased from?In the game of chess you can never let your adversary see your pieces0 -
TecBuyer are still advertising Fierce gaming PCs on Amazon.
OP - the warranty issue is a bit irrelevant really. Your real remedy is against TecBuyer as the retailer. Because you bought it from a third party on Amazon you need to follow Amazon's A to Z complaints route as explained in the first reply above. Have you made it perfectly clear to Amazon that that is what you are doing?
(You may need to explain to Amazon that TecBuyer are not interested in helping and referred you to the manufacturer's warranty. Tell Amazon that Fierce say the warranty is invalid because TecBuyer is not an authorised retailer of their products).0
