    'The defendant has filed a defence, a copy of which is enclosed

    Is this normal?

    Yes , that is the correct email address for the ccbc , but preferably all lowercase

    Copy in the lawyer firm , not the claimant , because HV ( Group Nexus ) are probably using a legal firm , so use their email address ( so not the actual claimant )

    I would expect it to be normal practice because your Defence is already filed

    Yes, perfectly normal. They don't need to send the Defendant a copy of the Defence.
    When a similar form is sent to the Claimant they will include a copy of the Defendant's Defence.

    Yes , if you received the auto receipt by email , but keep checking your claim history on MCOL , checking that the correct tick boxes are happening , until it goes to your nominated local court and they contact you

    Right, so I've sent the completed N180 form to the ccbcaq email address and have cc'd in dcb legal firm.

    It will be worth pulling together a Witness Statement and evidence file whilst it is all fresh in your mind; court could be some way off!

    Wondering if anyone can help me yet again. Im so fed up with it all I feel like paying but I'd have to get into debt to pay it anyway as I can't afford it.

    Today I received this letter, no idea what it means as I haven't received a date for court yet?



    Along with a witness statement with all of this legal stuff and things like pictures of the parking signs and the original letter that was sent to be telling me about the fine (I was in Asia for 2 months so never received and missed the appeal period anyway)









    I honestly have no idea what any of this means and I'm so worried about it. If I try and pay the £270 now will I get any repercussions for trying to take them to court in the first place? Could |I get a CCJ?

    I would love to take them to court as I know this amount for a 55 pound fine is obscene but I have no idea about legal stuff feel out of my depth and the stress is eating me alive. Any help would be appreciated as I'm suffering mentally with this.

    Even if you lost in court the total owed would be less , so pointless chucking in the towel

    Clearly you have received the witness statement plus exhibits from the claimant , which is the stage you are at , seeing as the hearing is in several weeks time ! Perfectly normal

    Both you and they have the same rules to follow , so the same date to file a witness statement plus exhibits plus summary costs assessment , in your case to the solicitors , plus also to the court. You should have an order from your local court with this information and the hearing date too , same as they did , so get it done ASAP ( you were warned about this last September by Le_kirk )

    Get your WS plus Exhibits etc done and email to the local court plus the solicitors too , one email , 2 destinations , so 2 addresses

    You should be following the 12 numbered steps by coupon mad in the defence template post , plus the what happens when post by Bargepole , linked in the newbies FAQ sticky thread post 2 , same as everyone else who has a court claim , please do so

    What does your MCOL history say? (I'm not sure if MCOL updates when a hearing date is allocated).

    The Claimant obviously believes that a hearing is going ahead on 18-Feb-22 ... as you're unaware then it suggests that your Notice of Allocation (NoA) went astray. Did you specify a court in your N180 DQ when you returned it? Perhaps ring that court (armed with the claim reference) for confirmation of the court date and to advise them that you never received the NoA so you were unaware of the hearing date, and likewise unaware of any filing/serving date for your Witness Statement and Exhibits?

    Given that they have sent you their WS, this will mean that your WS is imminent. Did you do any pre-work on it? Either way, get onto it straightaway.

    Once a case is passed to the local nominated county court of choice by the defendant , MCOL and the CCBC have no further involvement and MCOL has no updates , maybe it should , but it doesn't , but do follow the rest of the advice above
