Good, looks like you won that race then!  Send a SAR by email to Group Nexus and DO NOT fill in their form that asks who was driving!

Now, do yourself and all motorists a huge favour and make a long term difference and PLEASE get your friends and family to do the same as this affects them:

The Government Consultation into the level of parking charges, discounts, false ‘debt recovery add-ons’ (that no PPC actually pays)...

...and the Appeals Charter - that should IMHO result in full cancellations not enrich the PPCs by £20 or more because it would just encourage spurious PCNs that should never be issued...

    ...is now open!

This forum’s regulars are encouraging email submissions with evidence and photos, letters attached to illustrate what happened to you and why you are replying the way you are.

Show them your evidence by doing a full and detailed email reply, not the tick box exercise only.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Will do! I'll make sure to do this promptly :)
  • I have just received this from dcb legal on behalf of highview parking.

I was wondering what I should do next? I feel like I’m completely out my depth with all this legal stuff.

It would be greatly appreciated. Thanks!

The letter is all designed to scare you into paying.   "THEY INTEND" ??

The chances that DCBL will win for Highview is slim especially with their fake add-ons

You have to laugh at their last paragraph ..."in order to assist the court in achieving it's overriding objective" ..... what could that be? do they assume the court will be on their side ? HARDLY

Of course they don't tell you that when you win, you can claim costs against them and that means they pay you

Why would anyone want to reply to a scare tactics letter like that.  here is a clue that it is a fake claim ....

They add the fake amount and pretend it's part of the parking charge ... that is fake.
The claim will normally be signed by Yasmin Mia as a "statement of truth"
Impossible to be true and this must be pointed out to a judge for his/her consideration. Judges do not like fakers.

WRT the fake add ons, have you read this?  Have you complained to your MP?

    Excel v Wilkinson

At the Bradford County Court, District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) decided to hear a 'test case' a few months ago, where £60 had been added to a parking charge despite Judges up and down the country repeatedly disallowing that sum and warning parking firms not to waste court time with such spurious claims.   That case was Excel v Wilkinson: G4QZ465V, heard in July 2020 and leave to appeal was refused and that route was not pursued.  The Judge concluded that such claims are proceedings with 'an improper collateral purpose'.   This Judge - and others who have since copied her words and struck dozens of cases out in late 2020 and into 2021 - went into significant detail and concluded that parking operators (such as this Claimant) are seeking to circumvent CPR 27.14 as well as breaching the Consumer Rights Act 2015.   DJ Hickinbottom has recently struck more cases out in that court area, stating: ''I find that striking out this claim is the only appropriate manner in which the disapproval of the court can be shown''.

You never know how far you can go until you go too far.
  • Thanks for the heads up and I've reread the newbie's section so am aware of what's going to happen next. I was wondering when I'll receive the N180 DQ? I keep checking MCOL but nothing as of yet. It's been 6 weeks since my defence was received and just over two weeks since dcbl on behalf of Highview tried to 'scare' me to into paying up.

Cheers for all the help so far!

You cannot know when the CCBC will post it until the claim history says it's been posted , keep checking twice a week
