I have recently bought a detached house and my neighbours gate is drilled into the side of my house through a rendered wall. The said neighbour has just put large rocks were i reverse onto my drive complaing people go on his grass (not true) hes just a moody neighbour and got really angry when i asked him to remove the gate off my wall. If i remove it without damaging it would that be legal as hes refused to do so

Not really a bargain is it , nor local money saving .Did you buy the property with the neighbours gate fixed to the wall ??0

Yes it was already on0

I would start off by contacting Citizens Advice and see what they have to say and then maybe see if I could book one of those free introductory appointments with a solicitor to see what they have to say. If someone wants to drill the walls of property that belongs to others, they are supposed to ask permission.
What a shame that you have moved next door to this unpleasant person. Sounds like he's to be pitied but just because he's angry doesn't mean that you can let him get away with putting his gate where it's not wanted. Please note - taken from the Forum Rules and amended for my own personal use (with thanks) : It is up to you to investigate, check, double-check and check yet again before you make any decisions or take any action based on any information you glean from any of my posts. Pedant alert - it's could have, not could of.7 -
Was this flagged with your solicitor when you bought the house?I assume the previous owner didn’t flag any neighbour disputes - so that may imply they were fine with the gate.0

Where are the rocks? If they are wholly on your neighbours property hen they are his business - and won't affect you as long as you are staying on your own property.
So far as the gate is concerned, technically you may be entitled to remove the fixings from your wall but ask yourself why you want it gone. Is it causing damage or other issues for you? What do you want your neighbours to do instead?
It's tempting to demand it is removed specially if you feel that the neighbor is being or has been unreasonable in other ways, but equally, you may find it makes more sense to try to mend bridges (as it were) and to try to get to a point where you have a civil relationship.
If the fixings of the gate are causing a specific problem then address that, if the rocks are on your property, address that.
If you want to start a fight, talk to a lawyer first and go in with your eyes open to the likely finacial and other costs before you start. All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)3 -
A Story
A neighbour just moved next door to my detached house. Before we even had the chance to invite them round for tea (in the garden of course) they started complaining about our side gate that's been there for 8 years and which we had full permission from the previous neighbour to install. They didn't even want to compromise, just said "get that off my wall".
Then the next day after I put some rocks on my grass verge to stop those pesky delivery drivers ripping it up, they gave me dirty looks and didn't accept my explanation.
We didn't have any problems with the previous neighbours who were lovely.10
