County Court Business Centre

Hi all

I did try and google the forums about this and i know this is a bit of a duplicate post from as from others but i couldn't decipher some of the explanations so here goes; 

The Councty Court Business Centre wrote to me at my Mum's address (she has given me the letters a couple weeks later) where i am on the electoral register but have never had my car/driving licence registered at my mums. Nevertheless, this is the first i am hearing of this fine. They have included a response / admission pack

The fine totals £281 for parking in a Carpark next to Morrisons for 18 minutes without payment. It would have cost me £1.50 had i paid but what happened was that i was on the phone when i arrived in the carpark. When i got to the machine it didnt take cards and i didnt want to be hassled downloading an app for payment so i just left and parked in another location. 

It was in May 2020 during the lockdown

The letter is now over a month old so i have missed the 14/28 days deadlines due to not seeing my Mum

I tried to call the number to explain but there were 60 people waiting in the queue and right now i am studying and have exams and dont fancy waiting an hour to tell someone you wrote to me at the wrong address. 

My questions are: 
Can i just deal with this by post? 
Is it too late to contest/defend anything? its a month old
Obviously i do not want a CCJ on my name?
Would it be a defence that you wrote to me at the wrong address? (again the car has always been registered where i live) 


Also does anyone have a standard template that i can send as my defence please?

Seems very excessive for parking for 18 minutes, i went back and checked and it says the grace period was only 10 minutes so me being on the phone did not help.

I would really appreciate a standard template rather than someone say search the forum for  this and search that as i have tried that and i cant find anything suitable/appropriate

    The standard template by coupon mad is in the announcements above your thread , also linked in the newbies FAQ sticky thread near the top of the forum , again in announcements

    Post the name of the parking company involved ( the claimant )

    Post the issue date from the claim form below too

    You will be dealing with this by email

    You haven't said, but it looks like you may have received a County Court Claim Form.

    Please tell us the Issue Date on that Claim Form.

    Ignoring court papers is never a good idea.

    You can't find anything suitable?

    Go back to that screen where you started this thread. One of the first five threads listed there is entitled Suggested template defence to adapt for all parking charge cases where they add false admin costs.

    Is that what you are looking for?

    I don’t understand your difficulty.  This is a forum with a standard template defence thread at the top, in the announcements.

    Thanks for your reply, but i do not know what you mean by announcements? i can't see anything above that says announcements, i'm new here please pardon my ignorance.

    Have you done the AOS yet ? By logging onto the MCOL website and completing it ?

    Login , check , get it done , or check the date you did it and post the AOS submission date below

    With a Claim Issue Date of 21st May, you had until Wednesday 9th June to either file an Acknowledgment of Service or file a Defence.

    Since you did neither, the Claimant has been free since then to seek a Default Judgment against you, and indeed probably has done that already.

    Check your Claim History on the MCOL website to find out if that's already happened.

    If there has been no Default Judgment issued, then you are now in a race.

    If you file a Defence before the Claimant gets that Judgment, then you win this heat and go through to the next round.

    On the other hand, if the Claimant gets that Judgment first, it's game over - you lose.

    To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.

    Don't do that!

    The template defence IS appropriate and takes people less than half an hour to add their facts to point #2 and 3.
