I think you will need to explain to them (& us?) why you don't have your spare key.

If you'd given it to your ex (spouse/friend/etc) and never got it back then it might point to an individual as having taken the vehicle.

If you'd dropped it in the street last week then it could be anyone.

If you didn't report the lost or missing key to the insurance company to allow them to help you get a replacement then you have potentially been negligent.

Also would need to know the circumstances of the theft, if the vehicle has been recovered and if the mechanism used to steal the car has been identified?

Car was stolen on the Monday and found early hours of the morning , the police did not tell us it was found until the third day of calling them.  They told us they were waiting for it to be taken to the police pound.  due to a back log of crimes in the area they had not got round to informing us. in the mean time the car was stolen again, probably put on a trailer or
somehtjng and it has never been found.
we still owe finance and the insurance saying they won’t pay out due to the missing spare key.

Presumably because you've yet to prove that the 'missing' key is unrelated to the theft

Exactly but the car was involved in an accident when stolen and was
    not driveable.

So must have been initially driveable to have been in an accident.

please tell us what happened to the spare key? Were you never given it? Lost it?
we can’t help if you won’t tell us.
