Hi all,
I've read a lot of the posts on here, and all the advice looks very helpful and comprehensive. Hopefully I'll be able to get some help from you and I can be brief about it.
My case:
- I'm a self-employed contractor working for a small business. My vehicle has been issued 5x PCNs in late 2018.
- My vehicle had parked in shared, private residential and private commercial car park / loading bay behind an electronic barrier, accessed by key fob.
- Have 2x Letters Before Claim from Gladstones at my new address, date of issue is end of April 2021. 3 of 5 PCNs on one claim, other 2 of 5 PCNs on other claim.
- Sent email 1 week later as per **NEWBIES!! post #2 to request SAR from UK CPM and received file 10 days later.
- Can't remember if I've informally appealed to Gladstones previously, but do remember receiving reminder letters from them at an old address (no longer have these). Can't find any relevant emails in my sent folder. If I have, it's unlikely to have been based on the **NEWBIES!! template, as I found this advice only relatively recently.
- Summary of my emails with landowner's agent: General Manager of business I'm contractor for had parking space rental contract with them starting from 3-4 months after latest PCN. Their client was landowner during time my PCNs were issued. I'm yet to establish if anyone from the business had a contract or permission to use car park in that time, however staff at the business did have access to a key fob to allow vehicles in / out. I think I've exhausted the complain to retailer option on **NEWBIES!! thread(?)
Should I now do an online appeal on the UK CPM website, or concentrate on gathering my defence?

You can't appeal online to PCNs from 2018.- Have 2x Letters Before Claim from Gladstones at my new address, date of issue is end of April 2021. 3 of 5 PCNs on one claim, other 2 of 5 PCNs on other claim.You must reply to Gs by email:
- telling them the circumstances that you will rely upon and that you were authorised and given a keyfob, since you were working (blah blah) and had the authority of a resident(?) to park in their allocated space/or in the visitor bays, or whatever is true and were given a key fob, so were never a trespasser and not a person who should have been penalised. The reason for saying all this is it looks SOOO REASONABLE later to the Judge!
- asking them to consolidate the two LBCs into just one claim, as per the examples of replies to LBCs that refer to the case of Henderson v Henderson (search the forum).
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
