Fence Height on lower ground

Existing fence is 1.8m, so if her statement were true, even this would be the wrong height and it should be lower. I have told her privacy is a big time for me and I want 2m from my side as I am overlooked by many houses. I have even offered to paint her side to compromise but her solution is to remove the capping rail and switch the fence so she gets the clean look side. So obviously the height now doesn't seem a concern. I have decided to go ahead and if she gets written evidence from the council then I will trim it down myself. Else my offer to paint is always there for her.
