SUCCESS - CANCELLED! (UKPC Parking "fine" on leased car I no longer have)

Hi guys and girls. 

I have a lease car which went back to the leasing company last week. I have got a letter today from the old lease company with a photocopy of a ticket from those w....ers UKPC. (I've got a new car with a new leasing company)

Overstay by 20 mins. On a camera going in and out.

The date of the ticket was 03/05. 
Only got the letter from the leasing company today and when I check the ticket on the site it says £100 now 

They have obviously got details from DVLA of the leasing company. And the leasing company have given them my details. 

What can I do? I don't have the car anymore. Should I pay the £100 and stop the hassle of having the leasing company coming after me?

    What happened when you complained to the landowner?
    What type of car park was it and where?

    Did the lease company just pass you the NTK or did they give the scammers your contact details as hirer/lessee? They should have done the latter and then you should have received a NTH in your own name.

    If the alleged event occurred when you were the hirer/lessee, then you should appeal using the edna basher template you will find towards the latter part of the first post in the NEWBIES sticky thread.

    Do not reveal the driver's identity under any circumstances.

    Thanks for the swift reply! 
    I haven't complained to the landowner. I got home now from work and the letter see there.

    It's like a giant car park. With Matalan, next etc outlet kinda carpark. Occupier was in the gym. 

    The leasing company doesn't to have paid it, I think going by the letter (see attached) they have given them my details to issue me a ticket?

    The leasing company sent me the letter today so it's taken while to get to me 27/05. Because it was ANPR ticket I didn't know until now

    I think the leasing company have photo copied the ticket and just passed on to me.


    It's your standard B&Q type carpark. I can post the address if you like? 
    I haven't asked anyone like I said I just for the letter today an hour ago when I saw it. 

    So am I right thinking the leasing company has let me deal with it? Even though I don't use the car anymore

    That's good news. Too often we see a hire/lease company pay the scammers then charge the lessee the cost of the scamvoice and an admin fee.
    It's good they appear to have done the right thing, except calling a bunch of unregulated scammers and authority.

    It's not a case of the lease company letting you deal with it, it's a case of them complying with the PoFA 2012, a law that has been around since 2012. Either they pay it, appeal it, or transfer liability to the hirer. If they don't do any of that they leave themselves liable for the charge.

    You should now get a NTH in your name. The lease company can't (shouldn't) name the lessee as driver unless they were present at the time of the alleged event because otherwise such a statement would be untrue. They only know the details of the hirer/lessee. You need to make sure it stays that way.

    Read the NEWBIES thread, especially the three edna basher appeal templates. One is for fleet managers so the one you want will be one of the other two. When you receive the NTH, then appeal using the relevant template. The scammers will probably reject it, but then you make a PoPLA appeal where you should win because the scammers probably won't have complied with the PoFA 2012 and therefore can't hold a hirer/lessee liable.
    There is a link to the PoFA in the NEWBIES so you need to make yourself familiar with the Act, especially paragraphs 13 and 14. That's where the scammers will fail to comply.

    Also get pics of the site and signage in readiness. 

    As I said earlier, do not reveal the driver's identity. Do not hint at it; not even on here. Parking scammers read and post on this forum.

    The hirer/lessee should complain to them, to the retail park managing agents, and to the landowner.

    Should I wait for a "NTK" as I don't think what they sent was the NTK it was just the initial "invoice"?
    Technically I can appeal now? or should I wait?

    Another important thing is you MUST not call this a fine or penalty, even more so when dealing with hire/lease companies
