    Have you received the Claimant's WS and evidence?

    I reckon your best move is to file and serve your WS and evidence now anyway, and require the solicitor to include it all in the bundle.

    It seems preposterous that (just because they have a solicitor) the Claimant can file a bundle so that the rookie Deputy Judge can use that one sided load of tosh to decide that you need to pay up and/or decide what documents (from the biased bundle) are important, but the ordinary man/woman in the street (Defendant) is left thinking they can just show up with stuff on the day...which will annoy the Judge even though the D has had no directions to the contrary.

    I hate the small claims system quite a bit. It's meant to be for ordinary people but favours represented parties and Claimants and presumes money claimed is owed.

    Isn't that notice in respect of a Directions hearing rather than the hearing itself? (Albeit we have seen one or two cases where the judge has ruled on the case during the Directions hearing).

    This was what I received as part of a response to my Defence from BW Legal, otherwise I have only had the letter above. Upon reading another case on here I have seen the judge commented on the use of copy and paste with another case however, I do not see any irrelevance in the one I used so I took this more as a scare tactic.

    I wouldn't take much notice of that last one above , a typical we know best letter , designed to put you off and obtain a payment

    As for this preliminary hearing , I would follow the advice of coupon mad above and submit your bundle to your local court and claimants lawyer ( or claimant if no lawyers are involved ) , regardless !

    Better to do it than not do it ( it's called acting without permission and begging for forgiveness later )

    The court isn't going to complain , neither are we !

    IMO that amounts  to unprofessional conduct.  I would report the  firm to the  SRA   They are making assumptions which they cannot possibly prove.  It is insulting.  Complain here

    As the WS template I am using is not entirely relevant to my case, can I use some parts of my defence statement in my WS?

    Your witness statement should back up and support what you put in your defence, so there is little point in repeating it.  You should though provide evidence and the narrative that supports each point that you made in the defence.
