Hi Le_Kirk, Thanks for your reply. I am the director of said Ltd Company. The debt collection company said that Nation
Parking Enforcement have sent 3 letters but I haven't received any. Could this be a new tactic to increase revenue? They said that they don't have any proof of postage, nor do they need any.

Going back to my original point, is there an course of action here or do I wait for them to take me to court?
If the NTK and reminders are addressed to the Ltd Company why are they chasing you personally?

They're not but as the company director, it's up to me to take care of this, right?

While you might deal with it, everything should be done in the name of the person, or in your case, the entity to whom the original paperwork is addressed.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Private Parking Firms - Killing the High Street
  • Hi Everyone,

So I've had some back and forth with the company that issued the ticket and they're adamant that they sent the letters, although they haven't actually provided any proof of postage. Instead they have sent me a sub-contractor invoice that says they sent the letters. But to add another layer of complexity, it looks like the sub-contractor has sub-contracted to anothe postal service, who then allegedly gave the letter to Royal Mail. Now I understand why I never got the letter...

I've now seen the evidence alleged parking violation and it doesn't actually show our company vehicle parked outside of the bay, because of the angle of the picture. So it isn't clear we've actually done anything wrong.

Because we never received the previous letters, we never had the chance to appeal. But NPE is standing firm and saying that we owe the entire amount.

Am I right in thinking that our only remaining option is Route 02 The no-nonsense approach – tell 'em you won't pay from this article?

I'm more than happy to go to court but purely from a time and hassle perspective, I'd prefer not to. At the same time, there is zero chance I'm going to pay £160 for allegedly not parking wholly within the bay... even though they have zero evidence of this.

Stick to the advice you will find on this forum.
  • Hi Le, thanks for your reply. There's a lot of threads and advice on this forum and whilst I've read through a lot of it, I haven't found anything specific to my situation. Is there any specific advice on case where a person has not received NTK's, missed the appeal period and then steps on what to do after that?

In addition, that article is from the Money Saving Expert site.

To be clear - According to NPE, I have missed my appeal time period. So am I correct in thinking that my only remaining route is to wait for them to issue court proceedings and then present evidence and our appeal to the judge? I'm happy to do that. It just means I can wait for a court summons and go from there.

The article from the MSE site is not that same as this forum.  If you have missed their "self-imposed"  appeal periods you will have to wait for them to issue a letter before/of claim and follow it through with a claim and then you get to argue your points (with a defence and witness statement) in front of a judge.  It won't though, be a summons, it is a civil case and will be a N1 claim form from Northampton CCBC.

    It's a private car park and a notorious cash cow. Plan A has not been actioned because it turns out the sites owner isn't interested in quashing tickets. I don't even know how to contact the owner;
