Received Two Items

Hi moneysavingexperts,
I have just received an email from an online trader to explain that I have received two items when I only ordered one. They are requesting the second back. I originally purchased the item as a pre-order in mid-March (2021) and received delivery mid-April. I honestly didn’t realise the second was sent in error, I would have checked where we stood legally back then and I think the gap from order to delivery probably made the details a bit hazy. So I went ahead and unknowingly assembled them both. I’m assuming I’m going to have send one back assembled but would like a view of where I stand. Thanks!

You owe them either the product or the price of the product, so best to liaise with them to find the most mutually agreeable solution you can.3 -
It’s a tabletop strawberry planter, a sort of large frame. It cost £135 which for one seems a bit steep for what it is (certainly now I know it’s for one and not the two I received). I genuinely thought i should have received two when they came. I think you’re right though, it’s an error on both sides.JHW1942 said:

Just tell them you assumed two came in the set so both have been assembled, so although you are happy to un-assemble and return one, it has been used and not in its original condition.
Ask them to send a courier.

It's not yours to keep. They can demand it back, but it's their responsibility to collect it at their expense.
I think your question was really 'they sent me two by mistake, can I legally keep both since it's their fault?'No free lunch, and no free laptop

Yep, I genuinely did believe or rather assume I suppose that two were included. It honestly never occurred to me to check. I ordered the the item, when it arrived I just never thought there was anything unusual. It will teach me to be more thorough in future.pinkshoes said:

I think that was my question, maybe I wasn’t clear. I suppose I assumed posting this in consumer rights would make that obvious. But as others have explained I shouldn’t have received it, they can have it back (in a used condition) if that what the law says.macman said:It's not yours to keep. Wow! You guys are cynical. It was a genuine error on both sides. If it has to go back that’s what will happen, I’m not looking for the OK to keep something that wasn’t mine but seeing as I’m not an expert I was wanting advice on my consumer rights, I don’t quite understand why that warranted the haughty responses from some of you.1
