Care Parking at Stockport Peel Centre

    1. No payment was made. We were genuine customers of the food establishment that we parked opposite - Nandos. We ate our takeaway food in the car, and left. We didn't think we had to pay, and didn't see any signs to say we should.
    2. When you say "pay on exit", do you mean a car park with exit barriers? We definitely didn't go through any exit barriers. If there are barriers to the Peel Centre car park, this leads me to question whether the space in which we parked was actually on relevant land.
    3. It was during the times that are chargeable, a Tuesday afternoon.
    4. The reason given on NtK is "failure to pay for full duration of stay".
    5. The NtK appears to be POFA compliant if I was indeed parked (I argue the definition of parking includes leaving one's vehicle?), and it was indeed their land (no evidence of this). They haven't fallen down on any timings.

    Thank you for the links, which I will investigate further. It's the pay on exit part that now baffles me. We definitely drove in and out unobstructed.

    Further to this, having investigated on Google Maps (assuming the photos are recent), the portion of car park we used is Pay on Display, not Pay on Exit. Here are some images:

    No , no barriers , but plenty of signs on entry and around the whole site , pay on exit meaning pay at the machine and leave promptly , similar to airports and hospitals etc , read the links I gave you , the signage is shown because I checked before linking them, up to 2 hours is £1 , so 55 minutes is easily within the period of 120 minutes

    The driver has parked without any payment , in contravention of the signs , bilking !! ( Intentionally or unintentionally , it's bilking )

    On the roads this would be classed as driving without due care and attention

    By all means try a Popla appeal but nothing I have seen so far is a winner for you , especially since the new contracts and agreements and signs are less than 2 years old and that car park us now much fairer than under Excel ( although I believe that it should be free for patrons )

    So no , no barrier on exit , an honour system is in place , pay before leaving , at any machine , like ordering and eating a meal in a restaurant where you settle the bill and leave promptly at the end when everyone else is putting their coats on

    Then the driver should have done so !! But failed

    £1 for 2 hours , easily covered the time on site

    Ps , your signs are Excel signs , they lost the contract 2 years ago , to Care parking
    and Toys R Us went bust several years ago too

    Thanks. Yes, I recognise that the driver should have paid for a ticket, and they would have, had they known it was required. The reason I am (as the keeper) making an appeal is, I thought, in line with the spirit of the forum, i.e. that firms that exist solely to exploit people (charging a £100 penalty for failing to pay a £1 ticket) are "scammers". Are you now recommending I don't do this, and simply pay up?

    I am not recommending either , I give out the facts based on experience plus living not too far from that infamous car park and knowing it's history , including that it changed 2 years ago and is now much fairer in its use , plenty of reasonable signs , that Care probably complied with any laws and the BPA CoP and rightly have case against the driver , probably against the keeper too

    Of course you can go through the motions and hope for a miracle , but I cannot see one , not for bilking due to not complying with the onsite signage

    If you lose at Popla , then it's either pay in full or plead your case before a judge , your choice on what you do, not my problem !!

    I have given you facts , pictures of signs , the cost for 2 hours parking , the issues you face , links to pictures and previous threads , all you need to make a decision

    In this case I do not believe that you are being SC*mmed , because it's one of the best run car parks that I know of , now ( not under Excel when it was infamous and people were sc#mmed)

    If you convince me there are valid grounds for cancellation of the pcn contract in your possession , name them for me , don't assume ( you didn't even realize that those signs were old Excel signs , attention to detail is critical )

    Do the Popla appeal if you want to , I have no problem in you trying , but I cannot see any reason for it to succeed , nor do I think that the driver was being SC*mmed here either , even if you do , I see this as

    Landowner authority in place , check
    Good signage , check
    Reasonable charges to park , check
    POFA complied with , check
    The CRA complied with , check
    Non payment of the parking charge tariff , check
    Caught on camera in and out , check
    The £100 default daily tariff not exceeding the decade old limit of £100 , check

    Ps , it's a parking charge notice , an invoice , not a penalty ( not a fine either )  , no point arguing about the figure , not since the Beavis case 6 years ago

    Ok, thank you, I understand. I don't agree on the fairness point, but I get that this is now irrelevant.

    Does anyone else have a different opinion? Otherwise perhaps I shall cut my losses and give this miserable business my money.
