UKCPM & Gladstones - County Court Defence

Redx said:Email is ok since the pandemic , copy your email address , plus court , plus claimants solicitor into it , 3 destinations , so Gladstone's , local county court , you !!
The claimant will send a hired gun legal instead , sodon't assume that nobody is turning up , because somebody is , just not the solicitors or the claimant , but a third party , hired at the last minute , usually
If you didn't know this , you haven't read enough threads !!
The court probably didn't realise it's a bank holiday but the claimant did ,and you should have too , plus not later than means just that , not later than , hence last Friday was more reasonable , the 27th August , but not to worry , get it served by Tuesday the 31st
I did not know that, thank you. I've just read a couple threads and caught myself up on this. I'll have a deeper look into Right of Audience once I've filed the W.S..
I'll have a read over my statement again and then submit.

I'll have a deeper look into Right of Audience once I've filed the W.S..What are you intending in the context of 'Rights of Audience'?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I've got my hearing tomorrow and the court hasn't sent me any further information regarding the hearing since the initial scheduled court date.
It is via CVP and I've received no CVP information. According to their auto reply emails, I was also supposed to receive a notice 1 week before my hearing date too, which I haven't received.
I've called the courthouse over 10 times with no one answering. I've sent them an email too.
I've also called the Southampton court and it immediately hangs up saying all their operators are busy...
What do i do?
Update: Thankfully they've just sent it through to me!1 -
Hi, I'm currently sat in the CVP call which was supposed to start at 10:00. It's now 10:30 and the meeting still hasn't started. It just keeps saying "Waiting for the conference host to join, if you are the conference host, please enter the pin number now"
Is this a normal occurrence for the hearing to not start on time?
What should I do? Keep waiting?0 -
Very normal, do not expect John Lewis sevice from a government agency nowadays. IMO if they have not juoined soon iyou would be justified in putting in a complaintYou never know how far you can go until you go too far.1

I'll hold off on the complaint, hopefully they start soon as I'd love to get this over with!0 -
VICTORY!
The claimant didn't turn up at all.
The judge dismissed the case on the basis that there was no identified landowner authority.
He also dismissed it given the fact the vehicle was only there for 2 minutes 18 seconds which is not enough time to read the terms. But the main reason was the landowner authority.
I asked about the abuse of process, the £60 charges, and he said that a recent judge actually found it wasn't an abuse of process so that was interesting!
I don't know how I go about claiming any costs, we didn't mention it at all.
The hearing took 3 minutes tops.
I would like to thank everyone on this forum for your help. It has been amazing.

Well done! Although you should have brought up the issue of costs.... These PPC's and their minions are an absolute disgrace, not even turning up is an abuse in itself. Gladstones are comically useless...{Signature removed by Forum Team - if you are not sure why we have removed your signature, it's probably Gladstones}1

If you didn't say "Thank you sir (madam). Now, as to the subject of costs...." then you've (probably) missed the boat. (Unless you decide to raise a claim against the PPC).

Neverthe lessyou will have spent time reading about the law amd other stuff. Take revenge on the PPC, read this and decide whether you want to go after them or not. Clearly they had no reason to obtain your details from the DVLA .
