EMA airport fine for stopping at the fuel station BP Fuel station.

    On the NTK you are claiming that my vehicle was ‘STOPPING IN A ZONE WHERE STOPPING IS PROHIBITED’, this is not truthful. In a letter on XX/01/2020 from your administration team (unsigned) VCS made a new claim, and stated that, quote. “A review of CCTV evidence has confirmed that on the date in question, your vehicle stopped for an unreasonable amount of time in the fuel station where restrictions apply”. This letter did not state the time the vehicle arrived or left. How very confusing. The same letter also states that “Due to the fact that a contract was made, the driver has agreed to the terms and conditions!”

    My driver assures me that he  did not enter into any contracts, and if a contract would have been considered he would expect the opportunity to become acquainted with that contract first, and that basic legal right is mandatory according to the: IPC Code of Practice. Part B line 15.1 and 5.2 page 13. That states: Drivers should be allowed a sufficient amount of time to consider the contract and make an educated decision to accept or decline the contract. So this basic right was denied to my driver.

    This BP forecourt is being controlled as if it was a car park and not a BP petrol station with car wash and the usual forecourt services, plus the Spar Supermarket. This must be very confusing to the public who visit, lots must be strangers to the area.

    No Stopping signs do not belong on a petrol forecourt, The signs ‘STRICTLY NO DROP OFF OR PICK UP AT THE PUMPS’ are the most prominent signs visible, the signs declaring  ‘STRICTLY CUSTOMER ONLY PARKING’, ‘NO STOPPING’ are also very confusing by their contradictive implications. Compare the actual signs shown in the Site Boundary Plan (see Contract 4648/VCSHQ) with the actual sign positions, and it soon becomes apparent that this is not as the plan states. Positioning of some signs appear to be placed on the rear of canopy support pillars, facing away from the drivers gaze (my Photo 03) this is apparent on the video too, to me this seems to be a blatant attempt at entrapment.

    I plan on making Formal complaints against VCS Ltd to several of the Governing Bodies, East Midlands Airport, BP, Harvest Energy and my Local MP.

    Too late. Once court proceedings have commenced the Registered Keeper cannot transfer liability. But if you're protected as RK by the Protection of Freedoms Act 2012, Schedule 4 (VCS don't comply) why would you want to throw the driver under the bus?

    Just a quick update, I have just received a notice of discontinuance from Jake Burgess of VCS Ltd and also confirmation from ELMS Legal, so a brilliant result, having said that it has taken me hours of carefully compiled defence letters and email replies at each stage of this PCN. I don’t think this would have been possible without the help from the dedicated backbone crew on this forum, you know who you are, and I would like to thank you all very much.

    My last few complaints to Harvest Energy who are the owners of this BP Station were dealt with by Mr Ian Woodcock (retail director), he revealed that VCS Ltd only had the BP site contract for one year ( originally it was a 3 Year term) 24th June 2019 to 23rd June 2020) so from 2020 it re-negotiated with MAG East Midlands Airport (Manchester Airports Group, owning Manchester, London Stansted and East Midlands) to deal with VCS Ltd and if it helps anyone the man now in control at EMA is a Mr Jason King of Mag Property, the reional controller (jason.king@magproperty.co.uk)   This is definitely worth a shot for anyone to dispute/appeal for help.

    Below is my original letter to Mr King.........I think he then placed a little pressure on VCS Ltd too.................

    Dear Mr King, Ian Woodcock suggested I get in touch, he believes that you may now be able to help in ending this nonsense of my encounter with VCS Ltd, your parking enforcement company, who are operating within the East Midlands Airport, who have issued my car with a PCN Number VCS38xxxxxxx on 26/11/2019.

    Maybe with duty of care in mind you might feel me worthy of some assistance?

    I'm sure you will be amazed at the treatment I have had/experienced from VCS Ltd by innocently using the BP fuel station on site in late 2019, my vehicle was being used on one of the airport runs, and today I am still getting harassment and court threats.

    Is this something you can help me with please? Ian Woodcock/BP/Harvest/my MP have all contacted VCS but are being totally ignored, Mr Cornish CEO of EMA is yet to reply too, and so far no one has been able to get this parking charge rescinded, or maybe you would you not want to get involved ?

    I know this must be very low priority for you, but to me it is a very strong feeling of fair play/unjust treatment and very serious harassment for no good reason, I'm very sure that 90% of the victims involved with this company just roll over in fear, and pay them. Which is even more reason to uphold this unjust behaviour. I am well aware that some members of the public blatantly disregards the pickup and collection rules in force and do deserve the consequences, but VSC need to solve this problem without intimidating and bullying the true regular airport/BP station users, I'm sure this blanket attack of all visitors would ease if the enforcement officers were not given targets to attain and a bonus scheme to enjoy, a whistle blower let this information out on the BP Stations revues list!

    I will attach the latest word doc for you to get a brief taste of my particular event, and some relevant info, but a quick google search will open up the many hundreds of complaints and the ruthless actions of this parking enforcer that you employ. Airport staff and DHL staff are among the many internet stories of PCNs being issued, local media (Derby Telegraph, Daily Mail, Leicester Mercury, Money saving expert) describe this as a serious problem for customers, and surely this is not a good advert for a company of your status.

    Any help would be appreciated and would then return my faith in the British justice system and your Airport operations which I have used many times (my family and I have property abroad, also our friends frequently used EMA prior to Covid, obviously we hope to return to normal as soon possibly), I feel very strongly about the bullying tactics that VCS Ltd adopt. This needs urgent evaluation or we could very easily be travelling via Birmingham in the future.

    Sxxxxt , I have made contact with VCS and they have confirmed that the incident has been cancelled.  Apparently it was cancelled on my first intervention but they failed to let the interested parties know!  ( my comment only : Oh yes? HOW RIMISS OF THEM)

    I do hope this experience has not deterred you from using either our service station at the East Midlands or the brand BP nationally.  If anything else does come through to you please let me know directly.

    If you think that I can help in any way please get in touch, it would be great to organise a slow drive through this area as a protest, is anyone local up for something like this? Each vehicle purchasing a couple of pounds worth of fuel, and disrupting the area on a regular basis.......

    As I mentioned earlier, my next priority is a few formal complaints, starting with the DVLA, IPC, East Midlands Airport etc. etc.
