Football pumper never arrived

Hi,
I bought a football pumper on 18 April and it never arrived. after 2 weeks I emailed them but they never replied back. I then got in touch with PayPal and told them the issue and they messaged the reatiler. An hour or so later I get an email from them stating the pumper was out of stock but when I purchased it, it was in stock and they said it will now arrive on 4th June. And they didn't even notify me that it wasn't in "stock" so what are my rights in this matter am I able to sue to them?

You can sue them if:
a) a contract has been formed, most website T&Cs say contract is formed on dispatch
b) you can demonstrate what financial loss you have suffered as a consequence of the breach of T&Cs (subject also to any limits of liability in the T&Cs)
More likely you just cancel your order and get a refund.2 -

Hi I have another question. I bought a juniours Manchester city shirt on their official website and had no problems until the courier squashed the parcel through the letterbox as seen on the picture via my email by hermes. Unfortunately I wasn't at home when this happened. I get a call from my nephew saying when will it arrive and I told him it's outside in the letterbox. What !!!!!! me off was the courier didn't even knock on and the parcel could have been stolen. I spoke to Hermes and they said they would have a word with the courier. After that I emailed the Manchester city customer support team. I sent them the image of the squashed parcel and the date and time of delivery. I told them I believe my goods have been damaged but they would like too see the shirt. I am happy to send a picture of the shirt but if the shirt isn't damaged, am I still entitled to a refund, repair, or replacement under consumer acts right?

If the shirt isn't damaged, why would you want a refund, repair or replacement? Does it come in a presentation box or something that might have been damaged? It could have been stolen, but it wasn't, so there's no problem there.Adam990 said:Hi I have another question. As it's a distance sale, you are entitled to cancel the order within 14 days of receipt for a full refund, so nothing stopping you doing that and ordering a replacement from there or elsewhere, but you'll be sending back a perfectly good shirt and awaiting another perfectly good shirt, which seems like a waste of time to me.
If the shirt itself is damaged, then yes, you are entitled to a refund, a replacement or a repair.1 -
