  • Hi Ralph-y and all,
    I am back again and having jitters. I have been having all sorts of letters from UKPS and then Debt Recovery Plus regularly over the past 6 months or so. Then a new letter came from CST Law. As it is an "unpaid debt - reminder notice" and not an LBC, I ignored that one too. In the mean time, debt increased to £160! ( I have no idea why?!)
    Does that mean a LBC is imminent? I had assumed the stages in Newbies thread were possibilities and these guys may not go all the way. Hence I had asked if LBC would cost them money. It now feels like all stages happen all the time. 
    Is that right?

    If it's not an LBC , then yes you can expect a formal LBC to arrive , plus probably a court claim after that

    Just assume that UKPS will issue a court claim pack from the CCBC in Northampton via a lawyer firm , and plan accordingly ( what else do you expect a claimant to do for an unpaid invoice ??  I know I would chase it up , if necessary by using MCOL , no matter who owed me money )

    The notional figure increases because they all add a charge to it , they all want a piece of the pie

    They have added an extra unlawful amount for debt collection. Judges have dismissed an entire claim because of this on multiple occasions- see "Abuse of Process" thread.  This is the Test Case that address this practise of double recovery in the PPC world.

    Excel v Wilkinson

    At the Bradford County Court, District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) decided to hear a 'test case' a few months ago, where £60 had been added to a parking charge despite Judges up and down the country repeatedly disallowing that sum and warning parking firms not to waste court time with such spurious claims.   That case was Excel v Wilkinson: G4QZ465V, heard in July 2020 and leave to appeal was refused and that route was not pursued.  The Judge concluded that such claims are proceedings with 'an improper collateral purpose'.   This Judge - and others who have since copied her words and struck dozens of cases out in late 2020 and into 2021 - went into significant detail and concluded that parking operators (such as this Claimant) are seeking to circumvent CPR 27.14 as well as breaching the Consumer Rights Act 2015.   DJ Hickinbottom has recently struck more cases out in that court area, stating: ''I find that striking out this claim is the only appropriate manner in which the disapproval of the court can be shown''.

    All part of the mega scam.

    As you know, DRP are liars and fakers and 100% powerless

    They are mates with CST who in turn are not the smartest page in the book.

  • Thanks all. I read CST law thread. I had had a look at it before but spent much longer going through pages, seeing example letters etc... I will benefit from it. Is there an example letter to MP? Do I also need to send a SAR to DVLA?

    May I ask what you mean when you say "and plan accordingly ( what else do you expect a claimant to do for an unpaid invoice ??".
    All my prep at the moment is mental prep by reading these posts. This mater really gives me anxiety to be honest. I don't want to end up in court. Counting on them giving up later on.
    I am reading various posts to find out if and when they would give up but I couldn't find an answer yet. What is after the first LBC? Is there another one? What next? Please feel free to refer me to another post chain.
    Many thanks everyone and it is really not fair what these guys put people through.

    There are no MP templates , it's a bespoke personal complaint , you compose it

    I am not sure why you would send a SAR to the DVLA , unless you wish to check who accessed your data and when ?

    I expect a claimant to issue a court claim and enforce it , to make you pay for the unpaid invoice Nd to pay the legal fees and court fees

    I expect a defendant to defend the laim , to win and pay nothing

    That is where you are heading , court !

    You won't find many that give up , there's money at stake !

    Sometimes you may get more than one LBC , usually if the claimant change companies are brings it I house

    Most cases see one LBC followed by a court claim , I expect that in your case , but it's a slow , drawn out process
