Online retailer sold at the wrong price, shipped the goods and are now asking for more money!
Good afternoon *****,
We wanted to let you know that we had a technical issue when you placed your
order, 029520 placed on the 26/3/21 to purchase 1 x 1 x Kulson Sneaker
Size: UK 11 / EU 46 / US 12 £152.00
Paypal charged you in error of the amount of £39.00. This was due
to a tech bug in the system. Therefore Paypal under charged you by £113.00
May we please ask you to kindly make payment for the payment difference of
£113.00
We will send you a separate email via charge desk shortly for you to make
payment with ease.
Thank you very much in advance for your help with this.
Kindest Regards,
Hellen
My question is do I have to pay this additional £113 charge? Thanks in advance for any advice

So, what did the promo code offer you as a discount?0

To be honest I can't remember. It flashed up while I was on the site and was an Easter promotion of some sort.0

Depending on their terms and conditions I think your options are pay the £113, or return the goods. It will likely be covered under an errors and omissions clause.dandroid79 said:I purchased some Sneakers from an online retailer on 26th March. They offered a promo code and when i entered the code it reduced the price from £152 to £39! I thought that's a stonking deal and immediatly purchsed them and paid the £39 using Paypal. The retailer shipped the Sneakers and they arrived about a week later and all was good. Fast forward to Wednesday 28th Apri when i received an email from the retailer, see email text below -Good afternoon *****,

I would tell them to get paypal to deal with the underpayment. I would not pay the company direct.I am not a cat (But my friend is)1

So are they saying their "promo" code wasn't actually meant to give you any discount at all?

And you entered the promo code on their site or in PayPal?dandroid79 said:To be honest I can't remember. It flashed up while I was on the site and was an Easter promotion of some sort.0 -
tell them you no longer want them at that price and ask them to send you a returns label
however, if you are asking the legal position, the contract at the original price is valid unless they invoke the 'mistake' getout, in which case send them back.0 -

I would write back to inform them that since delivery, you've been wearing them daily as you were so pleased with your purchase at the promotional price you were given, and are already showing significant signs of wear, and so they have the option of collecting at their expense your used trainers and refunding you your payment, or honouring the promotion that was initially offered. I'd explain that you appreciate mistakes occur, but you in good faith believed the offer to be genuine, hence you purchased and immediately wore them. Any return would be at their expense, as it was their error. You may find that they then try and come to an arrangement somewhere between the price you paid and the price they want you to pay. I imagine it'll depend on the scale of the error - and how many pairs they sent out at the incorrect price. If it was a handful - you might find the response is to just keep them - but if the error was in the 100's or 1000's and the company is at risk - then they'll fight to get all the money/products back.5
