For the car on HP, how much is it worth and how much finance is left remaining?  If it is worth less than the finance, the OR will send a letter of non-adopt and then it is down to the HP company to decide what to do.

If there is equity in the vehicle, the OR may take it as an asset.

You've nothing for clothes, shoes, haircuts, dentist, opticians, internet, phone, emergency fund, school trips etc.

What's the age of the oldest kid?

    How much debt is there?

Are you still attempting to pay it? If so stop, save that money and then you can buy a runabout if you lose the HP car.

There should be a lemonfool income / expenditure link somewhere as you're missing a lot of outgoings.
Mortgage started 2020, aiming to clear 31/12/2029.
  • Hi thanks for the replies the 2 vehicles are worth approximately half of what is owed on both of them there is 11000 of debt and yeah we are still robbing Peter to pay Paul on the debts my kids ages are as follows 9 7 6 5 2 so quite a house full
The focus is worth 4500 it currently has 8800 left to pay
The zafira is worth 690 and has 1993 left to pay on ot I will have a look for the link now

I appreciate all of the help in times like these its soo hard to see a way forward.

I wouldn't even be considering bankruotcy again however we have council tax arrears from when we were both off the wards with covid we tried to make arrangements with our local council however they wanted and still do want 475 a month admittedly we were both off for a while my wife had it worse then I and still struggles now, but we will get there.
Right now the woman from the council said to me on Friday expect bailiffs any day now as irrespective of your circumstances im getting that money lol
She was a character to say the least

    How charmingly naive of her.

You should complain really. They may be able to find her a job she's more suited to.
  • I don't suppose id get anyway she's well known for having these sort of attitudes, I think her mind set is im privileged enough to be from a very wealthy family and have never been in financial difficulty so why should anyone else be !
She asked rhe reason for the arrears i told her I can't make our salaries stretch far enough and the nhs don't pay me sick pay
She then said I was lying so I had to email a copy of my contract over and she then went on to lecture me that I should have prioritised the council tax over feeding the kids !
Anyway they refused my offer of 250 a month for ten months which would have meant I was prioritising them over all non essential credit commitments
However she simply refused and said expect a bailiff
So now they will get ? Nothing i don't think ?

If there is less than 20k of debt then is it possible a DRO would be more suitable?

SOA calculator is here, format for MSE

Have a chat with National Debtline or StepChange and go through your circumstances and they can tell you if it’s an option.

I would stop paying any debts for now and save the money. I would also assume that the cars will be repossessed by the HP company
and save the payments to them to buy another car and tell the HP company to take the cars back before you go bankrupt or enter a DRO. You have time to get your ducks in a row before anyone goes to court.

  • Hi I spoke to PayPal and they said they dint recommend a debt relief order even tho I owe 13k so I'm just saving up for the 680 now
