Ah, it's about PCN's being sent to wrong address, so don't think it will work in this case

Still similar procedures , plus there needs to be grounds for a set aside , writing to the wrong address is the usual suspect !

Plus she was told about the correct draft order wording recently

The draft order is about why a set aside should be granted , whereas you seem fixated on the defence case , that won't happen until a later date if the set aside is granted

It's 2 separate issues , one follows the other if granted , so why are you contemplating the second half before the first half kicks off ?? There is no second half without scoring a goal in the first half !!

My friend got a 'notice of hearing' letter from the courts today, saying the courts will hear his case in April 2022.

I do intend on sending in a bundle of all the correspondence etc before hand.

If I get stuck I will come back for advice, and will update as and when anything else happens.

But just wanted to say thanks for getting me this far

So has the CCJ been set aside ? Doesn't usually take over 7 months for a set aside hearing , not if the CCJ is still active !

Hi Redx,

This is the only letter we have received from the courts on the matter. It doesn't say the CCJ has been set aside, only that a new trial hearing on the matter is set for April 2022?!

We did also receive an email from the acting solicitors, wanting to confirm the new address to 'update data controllers'. May just be my paranoia, but if the new address is confirmed, what's to stop them sending a baliff before this new hearing?

Could it be they need confirmation of their new address before issuing a set aside?!

He should provide an address for service.  And ring the local court to see if they made a mistake because a set aside Application is supposed to be a priority hearing.

Seen a few on here recently where hearings were not prioritised for the set aside , bought forward after a complaint to the court was made

Once set aside , the original case could be months away , after the set aside hearing , because the time pressure has gone

Just spoken to the court, the hearing in April 2022 is to judge on the set aside, not a retrial on the CCJ.

Was told it was due to the pandemic they had to put a lot of cases on hold, so working through the backlog etc!

Courts should expedite set aside hearings due to the negative impact victims face. It might be worth contacting the court and asking this to be brought forward as otherwise it could cause you financial hardship.
