Who is my agreement with - BT, Openreach or MJ Quinn?

Hello,

In March I moved home and had to have my internet reconnected. I contacted my ISP, BT, who said they'd send an Openreach engineer. Openreach sent a man who damaged part of my home alarm system (and failed to connect my internet). This cost £100 to fix. I contacted Openreach to claim this back and they told me that the engineer was from MJ Quinn - news to me! So it's MJ Quinn who need to settle this - so my email was forwarded to them to respond "urgently". That was several weeks ago and I'm yet to hear from anyone, though I have chased it twice (anyone except an agent at another organisation who deal with claims against Openreach - it's just contracts all the way down baby!).

My question is, who is my agreement with and who should I be considering taking to small claims court? Is it BT, because they're my ISP and it was their responsibility to send someone to my house in the first place? It's not a huge amount of money, and the court fees would be £25 anyway, but I'm just so annoyed about it and the dreadful way it's been handled. It's infuriating that a man can come into my home, break something and do literally nothing else and I have to pay for it.

Thanks for any advice.

Your contract was with your ISP and it's they who should sort it out. You dont have any sort or relationship with OR or MJ Quinn and trying to sort it out directly with either of them just confuses the situation.

If you haven't gone through the correct BT claims process then there's no point in taking them to court.
