She will have marital rights. What that looks like a judge will rule as it seems like it won't be an amicable settlement. She has two choices right now
1) wait till her appt. Nothing is going to have significantly progressed in a week unless it's been sold for ages a d in claiming stages
2) let the estate agent know the house is going to be subject to divorce proceedings which could delay any sale.

The financial settlement of a divorce looks at the entirety of the assets of the couple. Not just "the house".

She had no chance to be blunt, i spent £20,000 of my money and had to pay him £20,000 in costs trying to stop the above. Judges exact words were whilst you may have the moral high ground, you cannot prevent this poor man moving on from his marriage and building a new life. Yes poor man who left his 4 children homeless.0

She walked away with nothing, not even furniture, after he told them to leave. He opted out of work at the same time so has spent all the savings on living up until now. There’s no other assets at all other than two cars.0

Theres nothing she can do to stop that sale. The estate agents wont take instructions from her.
I had evidence of £25,000 paid towards the deposit, proof id paid the mortgage for 10 years, proof id renovated it. Counted for nothing.He may get ordered to pay her something - and she can put charges against his new house to secure that lump sum. But whether she ever sees it is another matter.Basically all the equity will go to the lawyers. Which might be better than letting him have it.0 -
