I would assume on the whole, it is whoever pays for it continues to do so and keeps both phones.The other person getting a new phone.1

How amicable is the split?
Are you going to be discussing the options/costs or not?
You could try asking for a PAC for your number and that should tell you the cost to leave.
the ex should get the charge and it may mess up their phone I don't know.
You could try asking the provider if you can do it.

Some networks allow change of ownership. The account holder needs to initiate it and you would have to pass a credit check to have it transferred into your name. Talk to TM for your options.1

To explain further: There is no 'right' to transfer the contract into your name. It is entirely the network's policy as to whether they will allow it1

Thanks everyone, I rang TM they said my ex-partner could contact them and they could give him a price of early repayment charge, and he could then request my phone number go to a PAYG account, I could then move it to a monthly contract.
The current contract runs to mid sept. So I could always wait until then and the same process applies.
I pay my share currently and I think the early repayment charge is effectively the remaining cost of the handset.
I also asked would I be entitled to an upgrade, TM said you could pick any phone and tariff available and switch to that once I move from PAYG to Pay monthly.I have not had a contract phone until this current situation so I don’t understand how the upgrades work.So I guess my options once it has been paid off ex-partners contract and on PAYG is to either go for a new upgrade phone/contract or SIM card only monthly and review phone hardware at another time.
if there is anything I have not understood, please let me know

If there's nothing wrong with the phone then it would be a lot cheaper to choose a sim only deal rather than paying for a shiny new phone for two years.
Do the sums and work out just how much the new phone is going to cost you and I guess you'll be horrified at just how much you end up paying over and above the sim only cost just to have the latest or poshest phone.Never under estimate the power of stupid people in large numbers1 -
