In other words, I'm agreeing with you that it makes sense to "focus our attention on remedies that may be available to people seeking guidance and assistance" but can't see how your cryptic comments thus far contribute to this (not that I have any actionable ideas in this scenario) - are you suggesting legal action against the agent? The airline? Or someone or something else? If so, on what basis?1 -
Thanks to everyone for taking the time to reply. One point I would like to add, in case it is of help to anyone else who booked via Travel Up. The terms and conditions linked in the post above are not the terms and conditions that were in place pre pandemic. Travel Up hastily rewrote them in April 20 and added in various additional conditions, for example the right to deduct an admin fee from refunds. This was not in their previous T&C's of which I thankfully have a copy.
However, for now I don't get to have that argument with them as have yet to see any refund. I am just wondering if there is any merit to making a claim on our travel insurance which was with LV, or will LV just say you have to wait for the airline to pay up, even if it means waiting several years.0 -
If the airline cancelled the flight then they are obliged to refund you (via the agent), so IMHO it's highly likely that your insurer will reject a claim, on the basis that the cost is recoverable from the supplier, despite the refund being delayed.1
