Reclaiming EE contract monies

A bad situation here we had an account with EE (mobile) I contacted them 5 years ago for a better deal but to no avail so I asked them to cancel it as it was my daughter’s contract fast forward to March this year I got a letter about RPI going up. It turns out they did not cancel the contract and I have been paying £35 a month since then. It’s run from an account that is not managed as it should but I went into the bank when I had contacted EE to cancel it but I myself have an EE account which is the same price so I thought my daughter contract had been cancelled so I left this DD in place as I thought it was my contract. So I have contacted EE who offered me 9 months charges back which is not good enough they said I have no proof that I cancelled it , so I contacted the ombudsman gave them all the details and they went with EE. I know I should have managed the acc account better but I did contact them to cancel I have no proof only that the phone has not been used at all no txt calls etc and why would I still pay £35 a month for this plus take out another contract with  three for £35. Feel at a loss really my wife and I both work for the NHS and this refund would be a godsend as we can’t afford to loose this much money. I am appealing the ombudsman decision at the moment so will keep you posted.

  • I think you might just have to take it on the chin & accept the amount offered. You fully admit you should have managed this better from your side & they're probably wondering why it took you 5 years to notice

    You didn't notice over 5 years and 60 bank statements that an extra £35pm was going out?
    Whether you used the service or not is irrelevant: the service was available to use. 9m refund, or £305, is extremely generous. You should accept it.
    Your only other option is small claims court, but you will lose. 
    No free lunch, and no free laptop ;)

    You can't afford to lose that much money but you never noticed it was going out for 5 years previously?  Seriously?

    Take the generous 9 months refund offered and move on.  Learn from this and look at your bank statements properly next time.
