Just make sure she doesn't say who was driving, in any contact that might get back to APCOA.

Because they choose not to bother with the POFA, this is dead easy for the registered keeper to appeal as long as this isn't a leased or hired car, and as long as the DVLA has the right registered address for the vehicle (check the V5C if you've moved since getting the car).

there's something seriously off if a site is selling significantly  more permits than it has spaces available for.
they might get away with a slight oversell, but if this oversell is significant and they know about it then something seems off
Hospitals have been doing this routinely for years now - Permit holders are normally informed on purchase that permits carry no guarantee of actually being able to park as the number of spaces on-site are far fewer than the number of permits issued.
Excepting a very few high-up admins and "critical" consultants of course!

Thanks for this. Does the POFA thing still work with contract parking where my wife is paying through her wages? The contract has her name on it.

The contract has her name on it.
Doesn't mean she was driving on the day!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

It's not a contract with Apcoa , so data breach if the trust pass on her data to Apcoa

We know they can assume. , But POFA does not allow assumptions about who was driving

It is the people who blab about who was driving , or imply it , in writing , who lose money !!

Think of it as like a "no comment" interview , with no actual proof , but do not overthink this

100% winnable v APCOA, nothing is different as long as they don't know who was driving.  It is their choice not to use the POFA para 9 words (at all...don't ask us to explain...).

  • The expected letter dropped through the door today, so, as per the previous helpful advice, the images are attached below. Any and all help appreciated with the appropriate response.

As an aside, I put in a freedom of information request to the hospital trust, asking about the number of staff permits and spaces. At the end of the wholly dodgy numbers they provided was this statement: "However the database is currently being analysed and amended as required, as a number of permits haven’t been renewed at present, as parking for staff remains free."

    Doesn't look free from this:

Yep, easy, copy any other APCOA thread.

We did already say it will be easy as it;s non-POFA and so the keeper must appeal (as per the NEWBIES thread).

Interesting that the Royal Stoke Hospital is happy that £50 is a sufficient deterrent.  That support the Government's position:

Can you show us a sign please, I'd like to know what the discount is.  Could your wife take a photo of a sign there with the £50 and whatever the discount is, showing, please?  I just want to see what the lowest sum is.

You need no other advice about an easy PCN anyway because APCOA are so easy to beat, so this question is for the greater good.
