As it's a hire or lease vehicle , use ones you have used previously based on Edna basher examples

1. Why not try it and see?bergkamp10 said:1. So you reckon I should still appeal on the website as it still gives me the option to appeal despite being months ago?
2. Also the original PCN that was supposed to be cancelled following the IAS Appeal is still showing as payable on the website.
2. Have PCM written to confirm cancellation? Make sure you hold on very securely to the written IAS decision for at least 6 years. We are starting to see old cases (2015/2016) that have been previously 'cancelled', now being raised as court claims - from memory, not PCM cases, but from a small number of other PPCs who have failed to update their records and have shovelled a whole stack of unpaid charge cases to one of the low-rent legals for robo-processing. Your previous case could be vulnerable to this at some time in the future.
So I have just appealed through their portal. I used the same template I used in my other appeal that won at IAS and just changed the PCN number. Let's hope for some good news.
I have the email from IAS saying it's been cancelled. I haven't received any letters however regarding this. I'll keep this safe as per your recommendation.
I've also received a yesterday another PCN from PCM. The PCN was issued on 21/05/2021 with the incident being on 05/04/2021.
1) Are they out of time?
2) Do I need to appeal?
3) Should I send the same appeal template I used and do it simultaneously with the one mentioned above or should I wait until I get an answer on that first?
1) That depends on whether or not there was a NTD.
2) Always appeal if a landowner cancellation is not forthcoming
3) If the circumstances were the same, then use the same appeal template, but wait if possible in case you get confirmation the first scamvoice has been cancelled.
In any case, contact the scammers and tell them what the IAS said and state you expect confirmation the charge has been cancelled.
You could also complain to the IAS that the scammer's cancellation has not been forhtcoming.
Keep that email safe for six years!

1) No, they are not out of time. They have up to six months to get keeper details from the DVLA and their trade association allows them another month to send a Notice to the Keeper. Anyone can chase anyone else for a debt for as long as they like but are restricted to a six year limit if they want courts to help them.
2) Of course. Just as the NEWBIES thread says.
3) Use the blue text template easily found in the first post of the NEWBIES thread.
1) I understand. Makes sense. Will proceed as normal then. Thanks.
2) Will do. I did it for the previous one, was just asking about this one in case someone mentioned that they are out of time and not to bother. But yes, I will appeal.
3) thank you. I used that appeal before for the exact same location with some amendments and have had cancellation at IAS stage, and have used the same one today regarding yet another PCN in the same location. I will probably use the same template as the one that won for me previously.
Thank you.1 -
Thanks mate. I'll use the one I used previously that was cancelled at IAS stage.Redx said:As it's a hire or lease vehicle , use ones you have used previously based on Edna basher examples

1) The PCN they just sent me was a Notice to Driver/Hirer.2) I understand pal. I will appeal following everyone's suggestions on here.
3) Yes, the circumstances are the same. The car was allegedly parked on the same street with the PCN issued by the same PPC.
Regarding waiting that's what I'm thinking as well. I have currently 3 PCNs with them apparently.
1 from 2019 (should have been cancelled following IAS but hasn't yet)
Another from 2019 (appealed today as their portal gave me the option so waiting and seeing there)
One from April 2021 (just received NTH)
Should I wait for responses to both the first two before submitting the latest appeal or just for the confirmation of cancellation of the first?0 -
You need to do what you think is best. It's difficult for us (well, for me anyway) to follow multiple PCNs when each one has a different timeline so at any given point you will be at a different stage for each one.I married my cousin. I had to...I don't have a sister.

Ah... a Notice to Hirer.
So you won't be using the blue text appeal, but instead using one of Edna Basher's appeals towards the bottom of the first post of the NEWBIES thread.3 -
I see no reason to delay any appeal after an NTH arrives1
-
I see mate. Understandable. Just wasn't sure how PPCs treat multiple PCN appeals at the same time in case they can see everything and decide to reject one PCN because they can see there are a few and don't want to end up cancelling them all if they give the wrong response. I mean is there one person looking at each one? Can they case handler see the other appeals at the same time? That kind of stuff.Fruitcake said:You need to do what you think is best. Basically the appeal that went IAS shoulda been cancelled but hasn't officially. The other two can be appealed through the portal, one PCN from 2019 just appealed today, the other from April just not yet.0 -
Yeah, I based my previous appeal on the Edna Basher appeal and added some bits from the successful case studies that the same post linked for hire vehicles.KeithP said:One from April 2021 (just received NTH)

You don't think they may see two concurrent appeals and put more effort into addressing them both than they did the previous one that was supposed to be cancelled at IAS? That's the only worry I have.Redx said:I see no reason to delay any appeal after an NTH arrives

No, they won't join up any dots or put in 'more effort'!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
