Only Appellate Court case forms a binding precedent on lower courts and so you'd not only need to wait for the case to be heard but for it also to be appealed and that case heard. Short of that they should consider previous judgements, though many are handed down verbally so it makes it more difficult, but aren't bound to come to the same conclusion.Daytona said:I guess that we could wait for these companies to conclude their cases and if upheld, it would be straightforward to claim via the small claims court for ~£80 ? ...but if everyone did this, then there would be no test case.
Any "test case" is however irrelevant if you cannot state and evidence what your financial losses have been.0
