Only Appellate Court case forms a binding precedent on lower courts and so you'd not only need to wait for the case to be heard but for it also to be appealed and that case heard. Short of that they should consider previous judgements, though many are handed down verbally so it makes it more difficult, but aren't bound to come to the same conclusion.

Any "test case" is however irrelevant if you cannot state and evidence what your financial losses have been.
