If the keeper was not the driver, it is not a good idea to repeatedly tell the whole world who was, or who probably was, driving the car at the time of the alleged event.
Parking scammers monitor this forum.

Its rather strange to come across a whole little community of people you have NO idea about, helping each other and complete strangers, on a day to day basis, against some of the unfair bits of life. Its all quite wonderful, and very humanitarian.

Very few of us know each other, or even know each other's names in real life, but we have come together due to a mutual hatred of these unregulated scammers, and our sense of fair play.

This bit is not correct, it has nothing to do with byelaws. It's simply a fact that Council owned land is not 'relevant land' and OPS should never have issued a Notice to Keeper to your partner telling her that she was liable. She was not liable as keeper, on BHCC land. The BPA recently told OPS to stop issuing 'POFA' NTKs at Stanmer Park, because they never should have been using that law. Since around Oct 2020, they started issuing 'non-POFA ones (driver liability only).
Also, there was no obligation upon her to name the driver but she can honestly aver that it was more than likely not the Defendant who parked that day. She remembers the unfair PCN but as the passenger and registered keeper, there is no liability in law that can bind this Defendant.

In fact I went to Stanmer Park at the weekend because OPS are gone - hooray - I went for a walk to meet a Brighton-based friend and to celebrate OPS not being there any more! Not kicked out, just gone, because BHCC have nearly enacted a traffic order and are going to start operating it themselves with pay and display machines and clear signs and lines, as required of a Local Authority.
The crappy, mostly broken and ankle-height OPS signs are still flapping around on the cable ties here and there, but there is no rogue ticketing now.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
