CCJ - First Parking LLP/DCB Legal unaware until I saw it on my credit record

    No Bailiffs will be coming round 

    This will be a long drawn out process , with no easy fix , so follow the processes and advice on here , or employ a lawyer

    I would email a SAR to the DPO at

    First parking

    Dcb legal

    The CCBC in Northampton

    This will flush out various documents

    Then it's decide on the set aside routes , the costs involved , and assume you get no money back so that any window are a bonus

    There will be no video evidence , so stop looking for it

    Gather your evidence and your documents , get a strategy in place , this will take a few months , possibly with a fight in civil court

    has a copy of the claim form on file, and can read you the service address off it. Insist on it. 

    They're not going to send bailiffs round. They're not however going to pay your fee, and you would always ask for costs anyway. Stop focussing on that

    AALL THREE ITEMS must be done ASAP. 
    Email the solicitors asking for consent to set aside as it was not your vehicle, you can prove this, and so they have filed a claim against the wring party. As you will win a set aside without consent, the option you're giving them has value as their client will only have to pay £100 instead of £255. Give them five days to respond. 
    But assume they won't consent

    Make sure you know your grounds to set aside. You have a LOT OF READING TO DO - no shortcuts.

    If the court has no record of serving the claim to an address (for claims they serve such as these) what would the barrier to invalid service be ?
    Are they running a competition to see who can slaver the most pish in a shift ?
  • SAR to First Parking LLP produced the above photographs (illegible number plate). I have never been to the car park and they clearly have misread the VRN on the photo as the quality is too bad. They have however set out my VRN correctly on the enhanced version of the number plate below.  How could they even read such poor quality photo. I've asked them for better copy photos but they say that's all they have and that the onus is on  me to prove it's not my car.

    Any ideas on how to proceed?

    No , the onus is on them to prove that it is your vehicle , their photos assist your case

    How have you gotten on with those three items above? 
    Your set aside is your only possible way to get this judgment off your file. Do it. 
  • I am just gonna pay the thieving b@stards as I don't want the CCJ registered.  My daughter needs me to be a guarantor for her university flat so I cannot afford to have a CCJ on my record.  One question though, if I pay is there any way to force them to show the video footage they have, can I raise a complaint with any official body to look into the practice of misread number plates?

    No , there is no official body. , It's an unregulated industry , so only your own local MP
    Plus there won't be any video footage !!

    Paying it only works if it's within 30 days of the judgement , longer than 30 days it's only satisfied and remains on file for 6 years

    Think carefully about it

     I found that my credit score had dipped because of a CCJ made against me on 4 March 2021
    OK, so you could pay it then apply to set aside the Judgment.  You should absolutely NEVER let them keep the money for this one if that's not your car.

  • It is within 30 days (CCJ dated 4 March 2021), so I will pay so that it is not registered then I will make the application to set aside and hopefully recover the money from them through the set aside.  Has anyone done this before?
