There some serviced apartments showing on Google Maps Street View called St George Wharf, could it have been there? Otherwise its all road on the approach to Vauxhall Bridge, very few opportunities to park!Princessrosie1 said:DCB Legal have now emailed me a copy of the NTK, claim form and Judgment, none of which was ever received by post. They all have my correct home address so it is a mystery why none have been received. There are two photographs on the NTK but the number plate is not clear. Offence alleged to have happened between 2 am and 4 am on 8 March 2020 at St George Wharf Car park (still don't know where this is) and NTK was dated 10 March 2020. I have now asked DCB Legal for the full post code of the car park. This is so that my partner can check and be absolutely certain about whether or not he was ever there before I make the claim to set aside.

You are right. DCB Legal have told me the full address is the car park at St George Wharf, Vauxhall, London, SW8 2LZ.Le_Kirk said:

Now for sure me and my partner know we haven't there and as I said the number plate is not showing properly can I still apply to set aside (as no original paperwork was received) and force them to provide the video evidence.Aiming to buy my first house at 45 and now learning to make 💷, keep 💷 and grow 💷 so any good investment advice is welcome fellow forumites. siumds like a misresd Of COURSE you apply for a set aside , one of the grounds being that this was not your vehicle.3 -
Does seem strange that you received absolutely nothing through the post until a Judgment had been made.
You may perhaps struggle to get a judge to agree that, on the balance of probabilities, that happened.2 -
I agree with @nosferatu1001, seems like a misread. The serviced apartments at that post code have parking (possibly only drop-off and pick-up) inside a tunnel, so could have been poorly illuminated at the time 02.00 - 04.00.2

I agree but nothing still by post. Another thing is my flat is on top of shops and sometimes delivery guys have to ring my mobile to locate the doorway so if the postman is not a regular they may have just not bothered finding the doorway. All docs I now have were sent by email. I will put together form N244 over the weekend and post here for some help please.KeithP said:Does seem strange that you received absolutely nothing through the post until a Judgment had been made.

I believe it was as we have never been there and the photo is not good. I will see if I can post here. If it is proved to be a misread will I be able to claim the fee back? Also can I write to DB Legal and tell them that I am applying for the set aside as I was never there and that the photo also does not prove it was my car.Le_Kirk said:I agree with @nosferatu1001, seems like a misread. The docs they have given me could have been "here is one I made earlier". The only way to really prove they had my correct address is to get the court to confirm the address to which the claim was sent. But they say they don't know as they don't keep records. Surely this system must be changed!Aiming to buy my first house at 45 and now learning to make 💷, keep 💷 and grow 💷 so any good investment advice is welcome fellow forumites. Cheers 🍾🥂0

You could send the CCBC a SAR and ask for all personal data they hold on you and copies of any paperwork served on, or about, you. The NEWBIES FAQ sticky, second post, explains how to send a SAR, with a link to a template. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Is it worth a shot writing to DCB Legal/First Parking telling them they have misread my number plate and asking them to apply to get the CCJ set aside by consent and for them to pay the fee or is that asking for trouble? Where they send baliffs round quicker?Aiming to buy my first house at 45 and now learning to make 💷, keep 💷 and grow 💷 so any good investment advice is welcome fellow forumites. Cheers 🍾🥂0
