  • I spoke to a friend who lives in the area. He has in the past received a letter from CP Plus 3 months after the incident, with no prior noticification. He complained that he hadn't received anything before, so CP Plus charged the "reduced" or original payment, something like £50. It seems like this is the way they operate.
    I also discovered that the car park is 3 hours free, except on a Friday, when its 1 hour free between 12 and 1 and 2 hours free after that. It's quite likely I was there above 2 hours.
    We have not moved house and the logbook is upto date.
    Complaints were from the "Keeper"

    For reference and to help anyone else in the same situation, this was a copy of the complaint:

    Dear Tina Prowley, 

    I'm writing to you in reference to a predatory letter received from Debt Recovery Plus regarding an alleged parking incident on 04/12/2020 at the Lion Retail Park in Woking, which I believe is under your management.

    The recorded PCN is XXXXXXXXXXXXXX

    The letter identifies the Creditor as CP Plus Ltd. However, I have received no communications prior to this date, nor any details regarding said incident. 

    In order to take an informed decision on how to deal with the above-mentioned document I would like to request further information on this alleged incident and the alleged parking charges of £170

    Please can you provide all photographic evidence that you hold on this alleged incident. I do not expect to pay for this information as it would be disclosable in any future court proceedings.

    I would be very grateful if you could send me evidence that besides your management duties within the car park, you also enjoy the rights of possession or occupation needed to be able to enter into an individual contract with drivers and to issue parking charge notices. I therefore require you to send me a copy of the contract that gives you authority to demand these payments.

    Further to the above, please explain fully on which of the following grounds your claim is based: trespass, breach of contract or contractually-agreed sum. Please note that if you are claiming that trespass was committed, I would like to receive a full breakdown of the actual loss suffered by your business or the landowner which could give rise to your claim for damages. If on the other hand you are claiming there was a breach of contract or a contractually-agreed sum, I would like to receive a copy of the contract which the driver allegedly entered into.

    Please note that I do not wish to receive a standard template answer which fails to address the specific issues that I have raised with you.

    I look forward to receiving your acknowledgement within 14 days and a comprehensive reply within 35 days (in accordance with the BPA AOS Code of Practice B.22.8). Only then will I be able to make an informed decision as to how I shall respond to your Notice to Keeper.

    The irony is that if there was a geniune breach, and they charged me at the time, I would have just paid it. Instead by trying underhand techniques of extortion and threating behaviour, they get nothing.

    I actaully am, but I wasn't in the car park for the mosque :smile: - it was during the covid 19 restrictions.

    I hope that CP Plus Ltd act on it, but I'll follow up to make sure. 
    You can check the status of your PCN on CP Plus website at any time, just go as if you were to pay it. Give it a few days for the cancellation to filter through. Take a screenshot once you see it cancelled, retain for posterity!

  • Not meaning to spam mu own thread but I would also like to re-iterate my thanks to @Coupon-mad and @blackdog2220 - even though I thought I'd read the newbies info, and thought my case was different (it wasn't the usual but it wasn't new), the info was in the NEWBIES post. This might not be fully over, but the process did work.
    Also, I did complain to my MP, maybe they can do something about the behaviour of these extortion rackets.

    now hang around , read threads and if you spot something that has been missed but you ave knolage of , jump in and help newcommers , you are now at a point where you understand the newbies thread and the reason for it , please passon the importance of reading it , to other first time posters

    That's good .... CP PLUS have no doubt got a scam problem, motorway services in particular
    They are now in the top 10 to get rid of when the new code of practice comes into force

    And do let your friends and family know that DRP are just circus clowns who belong the exclusive club called "The comedy of errors"   .... total idiots
