Each one is a separate entity ... what does this mean ?
The parking ticket must be the same entity as shown on the signs and a contract signed with the landowner must be the same entity name as both the ticket and signs

Below are the highlight points I will be using for the appeal. I have gathered these from the relevant thread and support from some members of the forum as well as reading the BPA Code. Nay revisions and suggestions will be most welcome.1. Grace Period: BPA Code of Practice – non-compliance
2. The operator has not shown that the individual who it is pursuing is in fact the driver who was liable for the charge
3. No Evidence of Landowner Authority - the operator is put to strict proof of full compliance with the BPA Code of Practice
4. No Evidence of Period Parked - NtK does not meet PoFA 2012 requirements
5. Vehicle Images contained in PCN: BPA Code of Practice – noncompliance
6. The ANPR System is Neither Synchronized, Reliable nor Accurate
7. The Signs Fail to Transparently Warn Drivers of what the ANPR Data will be used for
8. No Planning Permission from Birmingham City Council for Pole-Mounted ANPR Cameras and no Advertising Consent for signage
9. The signage was non-compliant with the BPA CoP
Re: Point 8 , I found out they had not made a planning application. I am waiting for confirmation from the planning team of Birmingham City Council in an email.

If you don't get a reply from the planning department before you need to submit your appeal, then change the wording of point 8 slightly.
State something like, there is no record of planning permission being approved for the pole mounted ANPR scameras at this site. The scammers are put to strict proof to the contrary.
More importantly, have the scammers obtained Advertising Consent for the signs? Not having it is a criminal offence (although only the council can pursue it, and sadly, most do not.)
PoPLA will probably ignore both points, but this info could be useful later; both to show that the scammers don't care about the law, and to show that PoPLA does not either and is therefore not fit for purpose.
You can also complain to the BPA about these points as well, but don't expect anything less than a bucketful of whitewash in return. They don't care about the law and are not fit for purpose either.I married my cousin. I had to...I don't have a sister.

That list of POPLA points includes stuff that is old hat and POPLA won't consider. Also the 'not being the driver' point is only relevant if the NTK in the post was a non-POFA one.
The only points that most POPLA appeals now have are unclear signs, no landowner authority and something specific to the case. The BPA consideration period is five minutes and the grace period is ten, but they don't get added together, not the way the BPA have written the 2020 CoP.

Always try POPLA, but restrict the appeal to the strong points that we know give the PPC difficulty in handling - landowner authority/contract, signage, PoFA fails (if NtK is not compliant), BPA Code of Practice fails, Grace Periods (but you need to understand that issue before adding it in).ZINXYX said:

I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
