  • ? Are you saying you used MCOL to file your defence?
     ThaT IS not how you do it. You file it ONLY by email.
    Apologies, yes - I had sent to CCBC by email.
    I checked on MCOL and it has been updated to say 'defence received on 22/03/201'.

    Phew!
    But really - this is a text only forum. You must give us precise informaiton!

    Do it right now and don't ask us for comments.  You may well have already lost the race now - unless you are showing us what you did submit already (HOPE SO!).
    I had submitted this when I updated MCOL with the detail, and added a comment to that effect in my post.  It appears I overtyped it while copying and pasting. Apologies for any confusion caused.
    What do you mean by "when I updated MCOL"?
    Nobody said anything about doing anything on MCOL.
    It looks to me that you have probably inadvertently filled 'a defence' via the MCOL website.
    Crazy!! Why did you not just follow the explicit instructions freely given to you?
    I'm out. Good luck.
    Apologies for misleading you briefly.  I followed the instructions explicitly and have emailed CCBC as directed.  To be clear, I haven't submitted anything at all on MCOL.
  • Thanks all.  I now have downloaded the Defence Questionnaire N180, and will complete that in-line with what Bargepole  has recommended.

    Sounds like you won the race and are now on track.  Make sure you don't drop the ball later when you get a hearing date and are required to do your WS.

    Thank you Coupon-mad.  I'm off on leave over the fortnight flanking Easter weekend, so will be working on my WS in readiness.
  • Good news, I think....  After receiving the following:

    - Notice of Intention to Proceed on 31st March, from BW Legal (no shock, really);
    - Notice of Proposed Allocation to the Small Claims Track from CCBC including DQ on 1st April ( as expected);
    - SAR from Link Parking with only one photo of my car with a date and time on it (not an entry and exit time!),

    I then received a Notice of Discontinuance from BW Legal advising that Link Parking instructed them not to pursue the debt!  MCOL is also updated to this effect.  Am I right in presuming I don't need to do anything else now?

    Huge thanks to all of you for your advice and guidance to date - I am very grateful that you share your time and experience with us all.

    Well done, nice outcome. If MCOL history is updated reflecting the discontinuation, that seems to be it.  👍
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    Nicely done, victory grabbed from the very jaws of default defeat!   Imagine if you'd lost this one by default, how unfair that would have been!
