I was patiently waiting for the hearing. I have proof that it would take place around 3pm. i was readily available but no one rang me. I found out that the C did not arrange the call etc with my details, whilst my details were present with the court. I have rang few times now but no response yet. Awaiting a letter with result. Would C not be liable to arrange this session which was meant to happen over the phone? I emailed the court to say that I have not heard anything past 3pm on the hearing date.

Surely that depends entirely on what the Claimant's revised Particulars of Claim say, doesn't it?

Or am I misunderstanding your question?

As above, it will depend on two things.

1 Whether the claimant does file a new amended POC, in which case you see what they say and submit your new defence/WS in accordance with the court order,

or

2 Whether the claimant fails to submit a new amended POC, and the claim is struck out.

So, it reads that this first claim was struck out due to them failing to arrange a hearing.

Presumably, it looks as though on 2nd June, you won this case I guess (unless VCS have reason to set aside that judgment).  But you haven't shown us that Order, you've only shown us the same new Order about the other case.

Did you not yet get a final outcome Order confirming this one was indeed struck out, as the Order about the other case, says it was?

Hi C-M,

I just enquired from the court office, that the DJ did not hear any of the parties, and have advised as per the letter.
also, they advised that I am not missing any court paperwork for this yet.

As the C failed to arrange a phone hearing, I would have said that it should be in my favour. Not sure if I have won the case (yet). VCS / court have not supplied any details about the setting aside of the hearing as such. I have just received this order, nothing else.

If I read the letter from court dated 25/02/2021, the C's solicitors were meant to arrange the hearing by telephone. This was not arranged.
