Land registry restrictions - No one has any details of this due to age

I would certainly talk to the solicitor sooner rather than later, as there is a real risk that if the bank manage to get to the detail, they are going to get stuck on confidentiality issues if, as you probably suspect, this is going to turn out to be a matter between the bank and the Ex...Razormatt said:

Well we got an email today asking us to call the collection dept with a ref number
spent a further hour on the phone to then be cut off but they confirmed there was 3 debt 2 were passed to a debt collection agent which were paid in full back in 2010
the third debt is for £10,600 and was an outstanding overdraft
Can’t understand why 2 of the 3 debts were passed to a collection agency yet this one wasn’t
Also I can’t believe Barclays would allow an overdraft of this size when that equates to a 1/3 of my partners annual wage now and remember this was back in 2007 so chance are it was more like 1/2 or 2/3 of her annual wage back the. And if this is the case it’s very poor lending on Barclays behalf
they have said they sent out a bailiff out in 2017 to the house but he was turned away stating no one with that name lives here yet my partner has owned the house for 18 years and why would they send a bailiff out 10 years after the court date
we both have almost perfect credit history and very high credit scores and pay all bills on time every month so wouldn’t look very good on either of us as we are financially linked to shy away from this debt
Again I’m not disputing the amount or wanting to walk away from it but it still doesn’t make sense, we have asked them to send us everything they have via Mail as they can’t send personal details via email so we can at least look at what they have so we can make our own mind up
we have also put a call in to the solicitor but they haven’t come back to us as of yet
This is really stressing me and my partner out out all we want is some straight answers which seem impossible
in 2 days this complaint can be passed to the ombudsman and maybe he will be able to make more sense of it

Final update Barclays came back to us with the actual account number of what was outstanding and it was never an overdraft but intact a personal loan but my partner had some documentation of old accounts she had paid off already back when she split up with her husband and the one they said was outstanding we have now proved it had already paid
They can’t explain why it was never closed on there system and just said it’s an error on there side even though we have a letter dated 2010 saying it was paid and closed from Barclays but they are now arranging for the restriction to be removed so we can move on with our remortgage
it was a hard slog but we got there in the end and they have even given a us a small amount of compensation for all the inconvenience they have caused with this as it transpires it was all there fault all along and down to the recoveries team not letting the department that deals with land registry restriction know that the account was closed with full and final payment
I’m glad we kept pushing for information and didn’t just pay what they told needed to be paid

Glad it reached a good conclusion in the end and a salutatory lesson for all on the benefit of keeping old bank records, you never know when they are going to help you out of a hole...

@razormatt Really glad to hear about the positive outcome and thank you for updating the thread. Hopefully it will help someone else in a similar situation. Unfortunately often times the only way to get banks to take you seriously is a formal complaint and then patiently chasing it up through the chain of people who can actually do something about it.
