Land registry restrictions - No one has any details of this due to age

So the original poster wouldn't have to provide any evidence othe than all parties have no record of the charge. It would then be for Barclays to prove that the charging order was still valid and needed to remain in place, given the information presented though I doubt Barclays will be able to do this meaning the court should dismiss the charging orderLand_Registry said:Remember you ask Barclays to release the charging order; the court to dismiss the order; or us to cancel/remove the restriction - all linked but very separate approaches
If Barclays won’t release it then you have to present evidence to the court to enable them to dismiss their order - I’m merely pointing out that ‘no information’ is unlikely to be enough but that’s where legal advice would help you re charging orders, settlement and timescales1 -
Just a quick update we finally got a call from Barclays yesterday to say they have now put someone in place to look at the complaint we put in
she did say she has done some initial investigation and she can’t find anything outstanding or even any accounts except my partners current Barclay card which is in good standing so she is trying to get hold of the team that removes property restrictions but she is having trouble engaging with them
so still not really any further on they only have a week left to deal with the complaint then it can be raised with the ombudsman if we want to which I don’t really want to do but if it’s the only way we can get Barclays to deal with this one way or another I don’t see any other choice0 -
Just a little update
We had an email today form the complaints handler as she can’t call as she is working from home
she said they have found an amount outstanding to the value of £10,661 but can’t tell us what or when it’s for, no account numbers or anything just an amount and to call the recoveries team to pay it off so they can remove the restriction
I called the number on the email as we want more information as to what it is relation to before I hand over £10k and they said they can’t help us without an account number
so back to square one
called the complaints team spent a hour on hold to be told they can’t help use as it’s been escalated to a team that doesn’t take phone calls but they are going to try and get someone to call us back
emailed back to Barclays from the email we received to receive a bounce back saying this address doesn’t receive emails and to call complaints
I really can’t believe it’s this hard to sort out surly if there is an outstanding amount they should have information as to why and what for ? Or do they think people are just going to pay something on there say so ?0 -
Look at the matter from the banks perspective. The restriction was properly imposed. Time has passed and those involved at the time simply say I have no recollection of events. In an attempt to walk away from the monies owed. Cuts both ways.Razormatt said:

It’s not that we want to walk away from it if it’s owed we will pay it the issue is if it’s a live account why can’t they give us information about it except the amount
we haven’t approached the solicitor but I’m guessing that will be the next logical move to see why this never came up when it should have
once again it’s not that we are shying away from it and if it’s owed it will be paid but I’m not going to hand over £10k without some more information0 -

Do you think it would be acceptable for the CC company to say they have no records of the transactions but all they know is that £xyz needs to be paid? Of course not.This must be hugely frustrating

I will say I have never said I can’t afford or I’m not prepared to pay an outstanding amount but of course I want details of what it is before it’s paid as you say what would you do if you got a bill through saying you owe xyz but they can’t tell you what it’s for
fingers crossed we will get some more information soon or I will take it up with the ombudsman maybe they can push Barclays to get the info0
