Good ordered from EU not arrived can I claim on credit card?

    I wondered how long it would be before someone chimed in with "Brexit"!
    Brexit is the entire reason for the customer's problems
    1a) Before Brexit - order from any of several suppliers
    1b) After Brexit - only one will ship to the UK
    2a) Before Brexit - no issue with value of order
    2b) After Brexit - supplier will only ship less than a certain value to avoid VAT issues
    3a) Before Brexit - smooth delivery in 8 days
    3b) After Brexit - import needs paperwork like 4x commercial invoice to get through customs, item stuck in customs due to problems with paperwork
    4a) Before Brexit - No import duty/VAT
    4b) After Brexit - good chance they will get taxes on receiving goods

    You can deny reality all you like but even OP acknowledges the problem has happened because of Brexit.

    Brexit was fundamentally a terrible idea for UK trade
    Great for the UK's Treasury coffers though. Every cloud has a silver lining.  :)

    I totally agree with Farfetch - Brexit was a terrible idea for the UK !! and I voted remain. I never had any problem before Brexit either with the suppliers or the shipping company - which in this case is UPS, (always was even when I used two other suppliers.)  It is my own fault for trying to order and to be honest I had not even thought about the tax implication ! Silly me !! It is now 5 weeks since the order was shipped. I have decided to wait another couple of weeks and also keep contacting the supplier again.  Every day I get an update from UPS saying the delay is due to Brexit problems which they are trying to sort out.  There is also a request not to phone UPS as there representatives will not be able to help any further. Watch this space ! Safe to say I will not be trying to order again, which is a shame as another EU company has now lost business, and the Veterano brandy is luscious !!

    If the supplier won't communicate with you that's nothing to do with Brexit. More a reflection of the Company culture that you've never experienced up until now.  I've had several items shipped seamlessly from Europe in recent weeks.

    Before Brexit I could order something from any of our EU colleagues and have it next day, it required a shipping label and there was no delay. Post Brexit, every parcel in/out needs commercial invoices both electronic and paper copies necessitating 8 pages to be printed. Now parcels take 3-4 days even going express due to customs checks and it will only get worse in April. We work directly with one of the biggest logistics firms in the world, our parcels are shipped from their facility to us, by them and we still cannot guarantee speedy service, it's on a par with deliveries from the US and Israel now. Anyone who works in import/export who doesn't think Brexit has made trade harder and requiring more admin work/delays is lying.
    I have worked in this sector for 42 years. In fact I have been in it so long that I was preparing Customs entries for EU goods before the requirement was dropped in the first place.  Yes, there are additional admin tasks and the systems for making the declarations are all in place and working.  Clearance does not require eight documents.  Unless other restrictions apply (licences, CoA's etc) you only require three documents - a waybill / consignment note, an invoice and a packing list.  These are required because the EU is now treated the same as the rest of the world.  All the stock for our fulfilment operation is fed into us from our warehouse in the Netherlands and it is moving seamlessly.  Any carrier having issues is having them because they haven't got their act together. 
    You may call me a liar if you wish but we are not having any issues with moving freight to or from the EU.

    the figure that import duty starts at is £ 135,- (€ 150,-) below this figure some companies in the eu will take the vat and pass it on to uk goverment , some wont and as you have found out many cannot be bothered 
    above  £ 135,- (€ 150,-)  import duty is payable and also the vat is not deducted at sorse , its charged along with import duty by the company that deliver it 

    I have had problems with motorcycle parts from holland being passed from customs back to seller back to customs , the main culprit was DPD who have made a right hash of brexit 

    this is copy / paste from suplier in holland , it might make sence 

    Dear UK customers,

    After the Brexit the rules of shipping products from an EU country to the UK have changed dramatically. Because of the last minute Brexit deal, the introduction and implementation of these rules was a race against the clock for many companies. The shipping companies and customs had to adjust their systems within 2 days.

    The new HMRC shipping rules to the UK:

    Orders up to £ 135,- (€ 150,-) including VAT and postage are delivered with 21% VAT, this is a rule ordered by the HMRC. For these shipments we will make an online import declaration. We have to keep all the details and make a VAT declaration to HMRC whereby the VAT is paid in the UK. In short, this means that for orders up to £ 135,-, we are responsible for paying this VAT amount to the HMRC on shipments to the UK.

    For order over £ 135,- (€ 150,-) including VAT and postage, the HMRC rules are different. We will refund the VAT to the customer and make an online import declaration. Packages send with PostNL are being taken over by Royal Mail in the UK. Packages send with DPD NL are taken over by DPD UK. The shipping company in the UK will request the recipient of the package for the UK VAT + shipping company fee / adminstration costs (+/- £5,- / £15,-). The amount of the UK VAT is based on the data on the import declaration. Your package will be delivered when you have paid for these costs. 

    As UK customs is currently overloaded, it is possible that some shipments will be delayed, which is of course beyond our control. Also, In the last 2 weeks, we experienced that some packages are being sent back to us without explanation which we then have to send again. We all have to get through this period of adjustment and will do everything possible to be of service to you as a Tomoshop customer as soon as always.     so , in order to work out what is happening with your parcel , look at the invoice , have that taken vat  from you (shown on invoice) and is the value inc postage above or below  £ 135,- (€ 150,-) 


    as a side note , I am now buying from places like california , whose prices on motorcycle parts are cheaper than europe , postage for 5000 miles is cheaper than europe (200 miles) and the customs seem to be hitting europe now rather than USA

    Customs clearance in Coventry for US shipments is always on the ball. Never misses an opportunity to levy VAT. Fortunately only on larger value shipments do they add import duty. 
  • as posted above I have had some financial sucsess this year with parcels from the USA , they may be on the ball , but perhaps a large proportion are now working on euro imports , another interesting thing is united states post office stick on decloration stickers seem to omit telling sender that the figure INCLUDES postage , so quite often the figure on the parcel is the USA price in dollars without any sales tax or postage 

    PS , non of the parcels that have come from the USA have been to coventry , the customs is london area as parcel tracking shows them arriving at gatwick ?? then simple ride up north to me
